OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING ORDINANCE NO. 139, 1993,
BEING THE ANNUAL APPROPRIATION ORDINANCE FOR
THE FISCAL YEAR 1994
WHEREAS, Article V, Section 4, of the City Charter requires that Council
shall adopt the budget for the ensuing fiscal year no later than the last day of
November, and that the adoption of the budget, the appropriation of funds and the
establishment of the mill levy shall be accomplished by passage of the Annual
Appropriation Ordinance; and
WHEREAS, on November 16, 1993, the City Council adopted on second reading
the Annual Appropriation Ordinance for fiscal year 1994; and
WHEREAS, Section 2 of the Annual Appropriation Ordinance included certain
language which required that the sum of $264,998 not be expended without the
subsequent approval of the Council by ordinance; and
WHEREAS, the intent of the foregoing language in the Annual Appropriation
Ordinance was to defer Council authorization of the expenditure of certain monies
for the compensation and staff support of four Service Area Directors of the
City, pending a report and recommendation from the City Manager regarding the
administrative structure of the City; and
WHEREAS, by subsequent motion of the Council at its same meeting of
November 16, 1993, the Council directed the City Manager to prepare such report
and recommendation; and
WHEREAS, upon further consideration, the Council considers it unnecessary
to withhold any funding for any administrative positions in the City while the
report and recommendation of the City Manager is being prepared; and
WHEREAS, the City Manager has agreed to provide such report evaluating the
current administrative structure and describing alternative administrative
structures on or before March 1, 1994; and
WHEREAS, Council believes it to be in the best interests of the City to
amend Ordinance No. 139, 1993, so as to eliminate the foregoing language from
Section 2 thereof, and that such amendment be accomplished by the passage of an
emergency ordinance, so as to ensure that the Annual Appropriation Ordinance for
1994 is finally adopted, including all amendments thereto, no later than the last
day of November, 1993.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1 . That the foregoing concerns and circumstances are hereby
determined by the Council to constitute an emergency within the meaning of
Article II, Section 6, of the City Charter.
Section 2. That this Emergency Ordinance shall be immediately effective
upon its passage on first reading.
Section 3. That Ordinance No. 139, 1993, be, and the same hereby is,
amended so that the first paragraph of Section 2 thereof shall read as follows:
Appropriations. That there be, and hereby is, appropriated out of
the revenues of the City of Fort Collins, for the fiscal year
beginning January 1, 1994, and ending December 31, 1994, the sum of
TWO HUNDRED THIRTY-TWO MILLION, SEVEN HUNDRED FORTY-ONE THOUSAND,
NINE HUNDRED NINETY-FIVE DOLLARS ($232,741,995) to be raised by
taxation and otherwise, which sum is deemed by Council to be
necessary to defray all expenditures of the City during said budget
year, to be divided and appropriated in the following fashion:
Section 4. That except as expressly amended in Section 1 of this
Ordinance, all other provisions �of Ordinance No. 139, 1993, shall remain in full
force and effect.
Introduced, considered favorably by 6 members of the Council of the City of
Fort Collins and finally passed as an emergency ordinance and ordered published
this 23rd day of November, A.D. 1993.
