HomeMy WebLinkAbout189 - 02/07/1995 - AMENDING CITY CODE REGARDING ROOF COVERING REQUIREMENTS ORDINANCE NO. 189, 1994 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING SECTION 5-27 OF THE CODE OF THE CITY OF FORT COLLINS REGARDING ROOF COVERING REQUIREMENTS WHEREAS, in December, 1993; the Board of Directors of the Poudre Fire Authority; pursuant to Resolution 93-12, recommended prohibiting wood roofing within the fire protection boundaries of the Poudre Fire Authority; and WHEREAS, subsequent to the enactment of said Resolution, substantial public discussion of this proposed prohibition has occurred,with hearings having been held before the Larimer County Planning Commission,and Building Board of Appeals,the City's Natural Resources Advisory Board and Building Review Board and the Council's Health and Safety Committee; and WHEREAS,on December 5, 1994,the Board of Commissioners of Larimer County imposed a Class B roofing standard for the mountainous areas of Latimer County and a Class C roofing standard for the remainder of the unincorporated areas of Latimer County; and WHEREAS,the City's Natural Resources Advisory Board and Building Review Board have recommended to the Council that the Class A roofing standard as contained in this Ordinance be adopted for the incorporated jurisdiction of the City of Fort Collins; and WHEREAS, in the interest of the protection of public health, safety and welfare, and particularly in the interest of protecting the public against the risk of injury, death and property damage caused by residential fires and the spreading of such fires,the Council has determined that, subject to certain exceptions, only Class A roofing materials should be permitted within the City; and WHEREAS, in the interest of promoting the preservation of historic structures within the City and not impeding the eligibility of such structures for historic designation or for federal or state grants or tax credits, the Council believes that such structures should be exempted from the Class A reroofing requirements imposed by this ordinance,provided that the replacement roof covering has a minimum rating of Class C. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Council hereby makes the following findings of fact: 1. That portions of the City of Fort Collins are located in the wildlands-urban interface area, in which area the risk of wildland fires increases the fire hazard risk for homes. 2. That the utilization of wood roofing significantly increases the risk of fire by reason of the combustion potential of such roofing. 3. That the utilization of wood roofing significantly increases the risk of spread of fire to adjoining properties by reason of the potential for wood roofing to emit burning embers. 4. That the utilization of wood roofing increases generally the depletion of forest reserves. 5. That the "historic' buildings within the City should be exempted from the Class A reroofing requirements of this Ordinance in order to protect the historic integrity of such buildings, provided, however, that such exemption should be narrowly tailored so as to avoid creating an undue risk of fire by insuring that any replacement roof covering of such buildings has a minimum rating of Class C. Section 2. That Section 5-27 of the Code of the City is hereby amended by the addition of a new subsection (39), with the former subsection 39 to be renumbered as subsection 40 and the remaining subsections renumbered accordingly; and that the new subsection (39) shall read as follows: Sec. 5-27. Amendments and deletions to code. (39) The second paragraph of Section 1906 is deleted. Section 3. That Section 5-27 of the Code of the City is hereby amended by the addition of the following subsections to be numbered as subsections (49) through (52), with the former subsections (49) through (52) to be renumbered as subsections 53 through (56) and with the remaining subsections renumbered accordingly; and that the new subsections (49)through(52)shall read as follows: Sec. 5-27. Amendments and deletions to code. (49) Section 3201(b)1. is amended by adding item "J" to read as follows: "J. ASTM D 225, Asphalt Shingles Surfaced with Mineral Granules." 2 (50) Section 3203 is amended to read as follows: "Roof-covering Requirements. "Section 3203. (a)New Roofing. The roof-covering classification on any new structure regulated by this code shall be Class A. "EXCEPTIONS: "1. Class B and Class C roof coverings may be applied on any building classified-as-a-Croup-R, Division 3-Occupancy and - on any building classified as a Group M occupancy that does not exceed one thousand (1,000) square feet of floor area; provided: "i. Such building roof extremities are located a minimum distance of five (5) feet to the nearest adjacent property line and are a minimum distance of ten(10) feet to another building; and "ii. The weather-exposed surface of such roof coverings is noncombustible or permanently coated with noncombustible mineral granules in accordance with American Society for Testing and Materials (ASTM) Standard, D 225; or when such roof coverings consist of materials specified in Table 32-E, Table 32-F and Table 32-G for built-up roofs. "2. Until midnight December 31, 1999, any Class B or Class C roof covering may be applied on any new construction that is added to an existing building classified as a Group R, Division 3 Occupancy, provided such existing building and new construction are located in accordance with the distances set forth in paragraph(1)(i)above. Thereafter,this exception shall expire. "(b) Reroofing. Reroofing shall be applied in accordance with this section and Appendix Chapter 32; and is subject to the following limitations: "Until midnight December 31, 2014, not more thana total of fifty(50)percent of the roof surface of any existing non-rated 3 roof covering may be replaced or covered with any Class B or Class C roof covering, and no portion of such roof surface may be replaced or covered with non-rated roof covering. Thereafter, when any existing non-rated roof covering is replaced or covered, the new roof covering shall be as specified in Section 3203(a) for new roofing. "EXCEPTION: 11 1. Any existing built-up, asphalt shingle, or listed membrane roof covering system may be replaced with a roof covering of the same materials and classification, provided the replacement roof covering has a minimum rating of Class C." "2. Any existing roof covering on a structure that is officially designated as a local or state landmark, or is listed on the National Register of Historic Places or is a "contributing structure" within an officially designated historic district or area, when such existing roof covering is determined by the Landmark- Preservation- Commission- to be- essential- to maintainsuch historic designation, listing or contribution, may be replaced with a roof covering of the same materials and classification, or such other roof covering as may be authorized by the Landmark Preservation Commission provided that the replacement roof covering has a minimum rating of Class C. (51) "Section 3204(e)" is deleted in its entirety. (52) "Table No. 32-A, Minimum Roof Classes," is deleted in its entirety. Section 4. That the effective date of this Ordinance shall be July 1, 1995.
