OF THE COUNCIL OF THE CITY OF FORT COLLINS
REAFFIRMING AND REENACTING SECTION 26-127(C)
OF THE CODE OF THE CITY OF FORT COLLINS
WHEREAS, on November 19, 1991, the City Council adopted on second reading
Ordinance No. 120, 1991 (the "Ordinance") ; and
WHEREAS, in Section 3 of the Ordinance, the City Council intended to and
did amend subparagraphs (a) and (b) of Section 26-127 of the City Code for the
purpose of changing the Schedule B, Meter Rates of the Water and Wastewater
Utility; and
WHEREAS, after the adoption of the Ordinance, a question has been raised
as to whether the Council also intended, in Section 3 of the Ordinance, to repeal
subparagraph (c) of Section 26-127; and
WHEREAS, the purpose of this Ordinance is to clarify that Council did not
intend in Section 3 of the Ordinance to repeal , amend or modify in any way
subparagraph (c) of Section 26-127; and
WHEREAS, the purpose of this ordinance is to reaffirm and reenact, to the
extent required by law, subparagraph (c) of Section 26-127 in order to give it
full , uninterrupted force and effect.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That the Council of the City of Fort Collins did not intend in
Section 3 of Ordinance No. 120, 1991, to repeal , amend or modify in any way
subparagraph (c) of Section 26-127 of the Code of the City of Fort Collins.
Section 2. That subparagraph (c) of Section 26-127 of the City Code is
hereby reaffirmed and reenacted, to the extent required by law, to read as
follows:
Sec. 26-127. Schedule 8, meter rates.
(c) Service outside the city. The monthly charge for water
taken through a meter by a user outside the city limits shall be one
and one-half (1 1/2) times the charge which would be made for the
equivalent service inside the city limits. When two (2) or more
taps are served from one (1) master meter, the monthly charge for
the city water passed through the master meter shall be computed as
follows: The average volume of water used per tap is determined by
dividing the amount of water metered through the master meter by the
number of taps. The charge for each tap is then determined by
applying to the average volume of water used per tap the rate
applicable to each tap for like service inside the city limits. The
amount to be billed to the master meter user is the sum of the
charges for each tap times one and one-half (1 1/2) .
Introduced, considered favorably on first reading, and ordered published
this 3rd day of March, A.D. 1992, and to be presented for final passage on the
17th day of March, A.D. 1992.
