OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING ARTICLE I, SECTION 24-1, and ARTICLE I, SECTION 29-1
OF THE CODE OF THE CITY OF FORT COLLINS CONCERNING SIGNS
WHEREAS, federal funding for the operation of the City's Transfort bus system will be
reduced in 1995 by $120,000 compared to 1994 federal funding for Transfort; and
WHEREAS, the City desires to provide bus shelters for persons using the City's Transfort
system but has been unable to provide as many shelters as are needed because of limited financial
resources; and
WHEREAS, research in this area shows that amenities such as bus shelters, benches and
good lighting are very helpful in encouraging people to ride buses both for the first time and more
often; and
WHEREAS, due to the reduction in federal operating funds, the City will not be able to
construct any bus shelters in 1995 with existing resources; and
WHEREAS, Transfort will be able to have bus shelters constructed and maintained by a
private business, without cost to Transfort, if the business is ahowed to place advertisements on the
bus shelters; and
WHEREAS, advertisements on bus shelters located on public property would be prohibited
under Section 24-1 of the Code unless said advertisements are exempted from this Code section; and
WHEREAS, advertisements on bus shelters constitute off-premise signs under Chapter 29
of the City Code and would be prohibited under Section 29-603 of the Code unless said
advertisements are exempted from the definition of "Signs" in Chapter 29; and
WHEREAS,the City Council has determined it is in the best interests of the City and of users
of the Transfort bus system to allow advertisements on Transfort bus shelters by exempting such
advertisements from Section 24-1 and from the definition of"Signs" under Section 29-1 of the City
Code.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that Section 24-1 and 29-1 of the Code of the City of Fort Collins are hereby amended
as follows:
Section 1. By modifying Section 24-1 of the Code of the City of Fort Collins to read as
follows:
No person shall erect any sign, as defined in Seeti6n'29-1 of the
Code, upon any street, sidewalk and other publicly owned area in the
city except signs over sidewalks which are connected to private

property and which are allowed under the Code, or traffic-control
signs and directional and information type signs which relate to
facilities and areas owned, maintained or operated by any
governmental entity. Before any directional or information sign is
erected, a permit must be obtained from the Director of Engineering.
The provisions of this section shall not apply to or limit the City in
publicizing community activities, celebrations and events.
Section 2. By the addition of the following subsection (15) to the definition of"Signs"
found in Section 29-1 as follows:
