OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING ORDINANCE NO. 33, 1988,
WHICH ORDINANCE CONSENTED TO THE
INCLUSION OF CERTAIN REAL PROPERTY
IN A LARIMER COUNTY SPECIAL IMPROVEMENT DISTRICT
WHEREAS, on March 15, 1988, the Council of the City of Fort Collins
adopted Ordinance No. 33, 1988; and
WHEREAS, said ordinance recited that "a portion of the improvements to
be included in the District would lie within the corporate boundaries of
the City of Fort Collins, Colorado (the "City") ," ; and
WHEREAS, subsequent to the passage of said ordinance, owners of the
property located outside of the corporate boundaries of the City have
withdrawn their property from inclusion in the County Special Improvement
District; and
WHEREAS, the description of the property to be included in the County
Special Improvement District was contained on Exhibit "A" attached to said
ordinance; and
WHEREAS, it is necessary to amend said Exhibit "A" to accurately
describe the property to be included in said District.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS
Section 1. That the second recital of Ordinance No. 33, 1988, is
hereby amended to read as follows:
WHEREAS, all of the improvements to be included in the
District would lie within the corporate boundaries of the City of
Fort Collins, Colorado (the "City") , and Section 30-20-603(1) (a) ,
C.R.S. , requires the consent of the City by ordinance before such
improvements could be constructed through a county special
improvement district; and
Section 2. Ordinance No. 33, 1988, is further amended by replacing
the existing Exhibit "A," attached thereto and incorporated therein, with
an amended Exhibit "A," attached hereto and incorporated herein, which new
Exhibit accurately describes the property to be included in the Larimer
County special improvement district.
Introduced, considered favorably on first reading, and ordered
published this 20th day of September A.D. 1988, and to be presented for
final passage on the 4th day of October, A.D.
