OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF RIGHT-OF-WAY FOR
HILL POND ROAD AS DEDICATED WITH
THE WINDTRAIL TOWNHOMES P.U.D.
AND RETAINING THE SAME FOR UTILITY
AND DRAINAGE EASEMENT PURPOSES
WHEREAS, the Owner and Developer of the Windtrail Townhomes P.U.D. ("the P.U.D.")
has requested the vacation of a portion of right-of-way for Hill Pond Road as dedicated with the plat
entitled"Windtrail Townhomes P.U.D." and more particularly described below; and
WHEREAS, at the time said plat was recorded, Hill Pond Road was planned to be extended
to the east of the P.U.D. to connect with future Centre Avenue; and
WHEREAS, the City of Fort Collins Natural Resources Department and the Owner and
Developer of the P.U.D. have agreed on a plan to minimize the impacts on the wetland adjacent to
the P.U.D.; and
WHEREAS,the extension of Hill Pond Road to the east as originally planned would disturb
a significant wetland area; and
WHEREAS, the Owner and Developer of the P.U.D. has platted new street right-of-way in
a location which will minimize the disturbance of the wetland area and provide access to future
Centre Avenue; and
WHEREAS, the previously platted right-of-way for the extension of Hill Pond Road is no
longer necessary or desirable to retain for public street purposes; and
WHEREAS, said right-of-way will be retained for utility and drainage easement purposes;
and
WHEREAS, all public and private utility agencies and the Poudre Fire Authority have been
notified of the proposed vacation and report no objection; and
WHEREAS,the rights of the residents of the City of Fort Collins will not be prejudiced or
injured by the vacation of said right-of-way.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the portion of right-of-way for Hill Pond Road dedicated upon the plat entitled
"Windtrail Townhomes P.U.D." and more particularly described as follows, to wit:
A tract of land situate in the Northwest Quarter of Section 23,T7N, R69W, of the 6th P.M.,
Larimer County, Colorado, more particularly described as follows:
Considering the South line of the Northwest Quarter of said Section 23 as
bearing N 89°39'45" W as determined by monuments found at the West
Quarter Comer and at the Center Quarter Comer of said Section 23, and with
all bearings contained herein relative thereto:
Commencing at the West Quarter Corner of said Section 23; thence along the South
line of the Northwest Quarter of said Section 23 S 89°39'45" E 1377.00 feet; thence
departing from said line N 00°20'15" E 248.00 feet to a point on a curve concave
Southeasterly,having a central angle of 90°00'00" and a radius of 15.00 feet; thence
along the arc of said curve an arc distance of 23.56 feet(said arc being subtended by
a chord bearing N 45°20'15"E for 21.21 feet);thence S 89°39'45"E 88.97 feet to the
TRUE POINT OF BEGINNING; thence continuing S 89°39'45" E 322.16 feet;
thence N 00°20'15" E 54.00 feet; thence N 89°39'45" W 292.16 feet to a point on a
curve concave Northeasterly having a central angle of 90°00'00" and a radius of
15.00 feet; thence along the arc of said curve an arc distance of 23.56 feet (said arc
being subtended by a chord bearing N 44°39'45" W for 21.21 feet); thence S
00020'15"W 54.00 feet to a point on a curve concave Northwesterly having a central
angle of 90°00'00" and a radius of 15.00 feet; thence along the arc of said curve an
arc distance of 23.56 feet (said arc being subtended by a chord bearing S 45°20'15"
W for 21.21 feet) to the TRUE POINT OF BEGINNING.

UNTO THE CITY OF FORT COLLINS for utility and drainage easement purposes.
