OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO EXECUTE A DEED OF CONVEYANCE FOR THE
SALE OF A 3.052 ACRE PARCEL NEAR THE INTERSECTION OF
DRAKE AND TAFT HILL ROADS
WHEREAS, the City's Electric Utility purchased a site near the intersection of Drake Road
and Taft Hill Road and across the street from Drake Crossing Shopping Center in the City of Fort
Collins ("the Property") in 1982 for a proposed substation site; and
WHEREAS, in 1985 a computerized system study was completed that determined that this
site was no longer needed as a substation; and
WHEREAS, the Electric Utility no longer has any use for the Property; and
WHEREAS, the Property has been offered to other City departments and the Housing
Authority, and Engineering and Parks and Recreation have identified needs for additional Drake
Road right-of-way and a Spring Creek Trail easement; and
WHEREAS, the City has offered the Property for sale to the public and received an offer to
purchase the remaining Property, subject to the City's need for Drake Road right-of-way and trail
easement, for the amount of$133,000, which is the best offer received by the City for the Property;
and
WHEREAS,the foregoing offer equals the estimated fair market value of the Property; and
WHEREAS, Section 23-111 of the City Code authorizes the City Council to sell interests in
real property owned in the name of the City, provided that the Council first finds,by ordinance, that
such sale or other disposition is in the best interests of the City; and
WHEREAS, Section 23-111 also requires that, with respect to real property which is a part
of the City's water or electric utility systems, the Council must find that the disposition will not
materially impair the viability of the particular utility system as a whole and that it will be for the
benefit of the citizens of the City.
NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the sale of the 3.052 acre parcel located near the intersection of Drake
and Taft Hill Roads and across the street from the Drake Shopping Center in the City of Fort Collins,
more specifically described in Exhibit"A" attached hereto and incorporated herein by this reference,
for the sum of One Hundred Thirty-Three Thousand Dollars ($133,000) is in the best interests of the
City and represents the fair market value of the Property.
Section 2. That the sale of the Property will not materially impair the viability of the
City's Light and Power utility system as a whole, and will be for the benefit of the citizens of the
City.
Section 3. That the proceeds derived by the City from the sale of the Property shall be
allocated to the Light and Power Fund.
Section 4. That the Mayor be authorized to execute such documents of conveyance as
are necessary for the City to sell and convey the Property on the terms and conditions described
above.

DESCRIPTION OF A PORTION OF THE CITY OF FORT COLLINS PROPERTY
A Tract of land located in the Northeast Quarter of Section 28,
Township 7 North, Range 69 West of the Sixth Principal Meridian,
City of Fort Collins, Larimer County, Colorado, the said tract is
also a portion of that certain tract of land described in a Deed
dated February 22 , 1982 and recorded in Book 2156 at Page 169
records of the Clerk and Recorder of the said Larimer County, more
particularly described as follows;
Commencing at the northeast corner of the said Section 28 ;
THENCE along the north line of the said northeast quarter of
Section 28, South 88 degrees 41 minutes 00 seconds West for a
distance of 630. 00 feet to the northerly prolongation of the
westerly line of the said tract described in Book 2156 at Page 169;
THENCE along the said northerly prolongation, South 00 degrees
00 minutes 00 seconds East for a distance of 30. 01 feet (recorded
as 30.00 feet) to the north line of the said tract described in
Book 2156 at Page 169 and to the TRUE POINT OF BEGINNING of this
description;
THENCE along the said westerly line, South 00 degrees 00
minutes 00 seconds East for a distance of 345. 00 feet;
THENCE leaving the said westerly line, North 85 degrees 06
minutes 47 seconds East for a distance of 401.35 feet to the
easterly line of the said tract described in Book 2156 at Page 169;
THENCE along the said easterly line, North 00 degrees 00
minutes 00 seconds East for a distance of 320.00 feet to the said
northerly line of the tract described in Book 2156 at Page 169;
THENCE along the said northerly line, South 88 degrees 41
minutes 00 seconds West for a distance of 400. 00 feet to the point
of beginning. Containing 132965 square feet (3. 052 acres) more or
less.
The above described tract is subject to all easements and rights of
ways now existing or of record.

true and correct to the best of my professional knowledge, belief
and opinion. The description is based upon previously recorded
plats and deeds and not upon a actual field survey._
