OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING PRIOR YEAR RESERVES IN THE CULTURAL SERVICES
AND FACILITIES FUND FOR A CITY OF FORT COLLINS/COLORADO STATE
UNIVERSITY PERFORMING ARTS COMPLEX ARCHITECTURAL STUDY AND
AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT FOR SUCH PURPOSE.
WHEREAS, several years ago, the City of Fort Collins completed a community-wide
feasibility study to determine the service needs and desirability of expanded performing arts facilities
in the community; and
WHER; As, the aforementioned studyprovided an analysis of space needs; costs; and a site
analysis and resulted in the determination that a need exists for an expanded performance hall,
meeting and conference rooms, mid-sized theatre and an outdoor amphitheatre; and
WHEREAS, during the same time as the City's study, Colorado State University (CSU)
conducted an analysis of its facility needs; and
WHEREAS, as a result of the CSU study improvements in the theatre, music, and visual arts
facilities were determined to be one of the university's highest priorities; and
WHEREAS, both the City and CSU have determined that similar needs exist to meet the
missions of both entities, and have been meeting to investigate the possibility of a joint use facility
to meet the needs of both institutions while maximizing the use of taxpayer dollars; and
WHEREAS, the City Council believes it would be in the City's best interests to jointly
contract with CSU to hire an architectural planning consultant to: (1) determine if both the City's
and CSU's needs can be met in one facility while maximizing the use of taxpayer dollars; (2)
develop a conceptual space plan to meet these needs; (3) further investigate site criteria and
locations; (4) develop design, construction, equipment and operation costs for a joint facility; and
(5) identify operational issues which will need to be addressed (the "Study").
WHEREAS, the cost of the Study would be $40,000; and
WHEREAS, the following have been identified as funding sources for the Study:
City of Fort Collins Cultural Services and Facilities
Fund Prior Year Reserves $10,000
City of Fort Collins Cultural Services and Facilities
Fund Existing Appropriations 7,500
Colorado State University 20,000
Fort Collins Foundation 2.500
Total $40,000
WHEREAS, Article V, Section 7 of the Charter of the City of Fort Collins (the "Charter")
provides that City Council may provide by ordinance for payment of any expense from prior year
reserves, notwithstanding that such reserves were not appropriated for expenditure in the annual
appropriation ordinance; and
WHEREAS, Article H, Section 16 of the City Charter provides the Council may, by
ordinance or resolution,enter into contracts with other governmental bodies to furnish governmental
services, or enter into cooperative or joint activities.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the City is authorized to enter into an intergovernmental agreement with
CSU to hire an architectural planning consultant to conduct the Study.
Section 2. That there is hereby appropriated for expenditure form prior year reserves in
the Cultural Services and Facilities Fund the sum of TEN THOUSAND DOLLARS ($10,000), to
be used alone with $7,500 from existing appropriations in the Cultural Services and Facilities Fund,
to fund the City's share of the costs associated with the Study.
Introduced, considered favorably on first reading, and ordered published this 21st day of
February, A.D. 1995 and to be presented for final passage on the 7th day of March, A.D. 1995.
