HomeMy WebLinkAbout144 - 12/05/1995 - AUTHORIZING TWO NON-EXCLUSIVE EASEMENTS FOR ELECTRICAL SERVICE TO POUDRE VALLEY RURAL ELECTRIC ASSOC ORDINANCE NO. 144, 1995 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY TO GRANT TWO NON-EXCLUSIVE EASEMENTS FOR ELECTRICAL SERVICE TO POUDRE VALLEY RURAL ELECTRIC ASSOCIATION, INC. WHEREAS,the City of Fort Collins is the owner of the land known as the Meadows Spring Ranch in Larimer and Weld Counties, Colorado; and WHEREAS, the City of Fort Collins needs electrical service for a new facility being constructed on Meadows Spring Ranch; and WHEREAS, Poudre Valley Rural Electric Association needs non-exclusive easements as shown on Exhibit "A", attached hereto and incorporated herein by this reference, to construct, operate,_maintain,_repair-and-replace power lines; WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized to sell, convey or otherwise dispose of real property owned by the City, provided the Council first finds by ordinance that any sale or disposition of real property owned by the City will not materially impair the viability of the utility system as a whole if the property is part of the system and that the sale is inthe*nest interest ofthe City of Fort Collins. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the above-described sale and conveyance of easement interests is in the best interest of the City of Fort Collins. Section 2. That the Mayor is authorized to execute two Easement Agreements conveying non-exclusive easements for electrical service to Poudre Valley Rural Electric Association, Inc.
