OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF STREET RIGHT-OF-WAY
FOR REDWOOD STREET ADJACENT TO LOTS 1 THROUGH 12
OF THE REPLAT OF EVERGREEN PARK 2ND FILING
AND RETAINING TTIE SAME FOR UTILITY
AND DRAINAGE EASEMENT PURPOSES
WHEREAS, the Owner of Lots I through 12 of the Replat of Evergreen Park 2nd Filing
has requested that the City vacate a portion of the right-of-way for Redwood Street adjacent to
said Lots, more particularly described below; and
WHL'REAS, the right-of-way originally dedicated for Redwood Street was eighty (80)
feet in width to conform to the City standards for a collector street at that time; and
WHEREAS, subsequent to said dedication, the City has determined that the right-of-way
for certain collector streets can be reduced and still accommodate two travel lanes, bike lanes,
sidewalks, and other public street purposes; and
WHEREAS, the City has determined that the right-of-way for Redwood Street between
Conifer Street and Willox Lane can be reduced from eighty (80) feet in width to fifty-five (55)
feet in width; and
WHEREAS, the reduction in the right-of-way width necessary for public street purposes
makes it necessary and desirable to vacate the excess right-of-way adjacent to Lots 1 through 12
of the Replat of Evergreen Park 2nd Filing; and
WHEREAS, all public and private utility agencies and the City Transportation and
Engineering Departments have been notified of the proposed vacation and report no objection;
and
WHEREAS, the right-of-way proposed for vacation, more particularly described below,
will be retained and reserved for utility and drainage easement purposes; and
WHEREAS, the rights of the residents of the City of Fort Collins will not be prejudiced
or injured by the vacation of said right-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS that the portion of right-of-way for Redwood Street more particularly
described as follows, to wit:
A part of Redwood Street situate in Replat (No. 1) of Evergreen Park and in Greenbriar,
City of Fort Collins, County of Larimer, State of Colorado, which begins at the
Northwest corner of Lot 12, Block 4, Replat of Evergreen Park, Second Filing, and
running thence S 00°00'23" E 331.89 feet; thence along the arc of a 392.82 foot radius
curve to the right a distance of 201.45 feet, the long chord of which bears S 14°41'06" W
199.25 feet; thence S 29°22"35" W 94.22 feet; thence along the arc of a 312.82 foot
radius curve to the left a distance of 160.42 feet, the long chord of which bears S
14041'06" W 158.67 feet; thence along the arc of a 398.14 foot radius curve to the right a
distance of 175.25 feet, the long chord of which bears N 12°36'14" E 173.84 feet; thence
N 250 12'52" E 72.35 feet; thence along the arc of a 453.43 foot radius curve to the left a
distance of 199.59 feet, the long chord of which bears N 12°36'14" E 197.99 feet; thence
N 00000'23" W 421.43 feet; thence along the arc of a 15.00 foot radius curve to the right
a distance of 23.57 feet, the long chord of which bears N 44°58'33" E 21.21 feet; thence
N 89057'30" E 25.00 feet; thence along the arc of a 15.00 fool radius curve to the left a
distance of 23.57 feet, the long chord of which bears S 44°58'33" W 21.21 feet; thence S
00000'23" E 89.56 feet to the point of beginning AND ALSO beginning at the Northwest
corner of Lot 25, Greenbriar Village P.U.D., Third Filing, and run thence S 00°00'23" E
134.99 feet; thence along the arc of a 15.00 foot radius curve to the left a distance of
23.57 feet, the long chord of which bears S 45'01'27" E 21.22 feet; thence S 89°57'30"
W 25.00 feet; thence along the arc of a 15.00 foot radius curve to the right a distance of
23.57 feet, the chord of which bears N 45°01'27" W 21.22 feet; thence N 00°00'23" W
135.00 feet; thence N 89°59'37" E 25.00 feet to the point of beginning.
be, and hereby is vacated, abated, and abolished,
RESERVING, HOWEVER, UNTO THE CITY, THE SAME AS AN EASEMENT FOR
UTILITY AND DRAINAGE PURPOSES.
