OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING PORTIONS OF STREET RIGHT-OF-WAY
FOR FINCH COURT AND HAWKEYE STREET
IN THE PARAGON POINT P.U.D.
WHEREAS, on July 24, 1995 the Planning and Zoning Board granted final approval to the
Paragon Point P.U.D. Phase Five; and
WHEREAS, said P.U.D. replats portions of the Finch Court street right-of-way in order to
properly align the street intersection with Hawkeye Street; and
WHEREAS, said replat makes it necessary and desirable to vacate certain portions of the
street right-of-way for Finch Court and Hawkeye Street, more particularly described below; and
WHEREAS, said vacation will result in a consistent right-of-way width for Finch Court and
its intersection with Hawkeye Street; and
WHEREAS, additional right-of-way and utility easements have been dedicated to the City
to provide consistent right-of-way width and the standard area required for utility easement purposes;
and
WHEREAS, all public and private utility agencies have been notified of the proposed
vacation and report no objection; and
WHEREAS, the rights of the residents of the City of Fort Collins will not be prejudiced or
injured by the vacation of said right-of-way.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the portions of right-of-way for Finch Court and Hawkeye Street more particularly
described as follows, to wit:
Portions of right-of-way on,over, and across a portion of Paragon Point P.U.D.,Finch Court,
as described in Reception No. 94040094, recorded May 9, 1995, Larimer County, Colorado
more particularly described as follows:
Beginning at the Southeast Corner of said Finch Court plat; thence along the south line of
said plat North 88'45'13" West 2.88 feet to the beginning of a non-tangent curve concave
to the East, having a central angle of 08°27'07", a radius of 213.00 feet and a chord bearing
North 03°17'54" East, 31.39 feet; thence Northerly along the arc of said curve 31.42 feet;
thence North 07°31'28" East, 27.59 feet to a point on the East line of said plat, thence along
the East line of said plat South 02°28'30" West, 58.81 feet to the point of beginning,
containing 128.68 square feet, more or less.
TOGETHER WITH a parcel described as follows:
Beginning at the Southwest Corner of said Finch Court plat; said point being the beginning
of a curve concave to the East, having a central angle of 09°09'04", a radius of 577.00 feet
and a chord bearing North 05°49'08" East,92.06 feet;thence along the arc of said curve(also
west line of said plat)92.16 feet to the Northwest corner of said plat; thence along the north
line of said plat South 82'11'37" East, 2.42 feet; thence Scum 07°31'28" West, 54.54 feet
to the beginning of a tangent curve concave to the east, having a central angle of 08°00'44"
and a radius of 267.00 feet; thence along the arc of said curve 37.34 feet to a point on the
south line of said plat; thence along the south line of said plat North 88°45'13" West, 2.30
feet to the point of beginning, containing 242.06 square feet.
TOGETHER WITH a portion of right-of-way for Hawkeye Street on, over, and across a
portion of Paragon Point P.U.D., Phase Four, as described in Reception No. 93076578,
recorded October 18, 1993, Larimer County, Colorado, being more particularly described as
follows:
Beginning at the Southwest Corner of the intersection of Hawkeye Street and Finch Court
as shown on said plat; said point being the beginning of a curve concave to the Southwest,
having a central angle of 100°31'29", a radius of 15.00 feet and a chord bearing North
39°44'15" West, 23.07 feet; thence along the arc of said curve (also Southwest line of said
plat) 26.32 feet; thence departing from said line North 90°00'00" East, 2.42 feet to the
beginning of a tangent curve concave to the Southwest, having a central angle of 97°31'28"
and a radius of 15.00 feet; thence along the arc of said curve 25.53 feet; thence South
07°31'28"West, 1.11 feet to a point on the South line of said plat; thence along the south line
of said plat North 82'11'37" west, 2.42 feet to the point of beginning, containing 43.33
square feet, more or less.
be, and the same hereby is, vacated, abated, and abolished.
Introduced and considered favorably on first reading and ordered published this 3rd day of
October, A.D. 1995, and to be presented for final passage on the 17,th day of October, A.D. 1995.
