OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING CHAPTER 7 OF THE CODE OF THE CITY OF FORT COLLINS
TO PROHIBIT FALSE CAMPAIGN STATEMENTS
WHEREAS, the Uniform Election Code of 1992 prohibits false statements
relating to candidates or questions submitted to the electors; and
WHEREAS, municipal elections in the City of Fort Collins are governed by
the Municipal Election Code, rather than the Uniform Election Code; and
WHEREAS, the Municipal Election Code does not expressly prohibit false or
misleading campaign materials; and
WHEREAS, the Council Governance Committee has recommended that the Council
consider the adoption of a local ordinance prohibiting false campaign statements;
and
WHEREAS, the Council of the City of Fort Collins (the "Council ") believes
that it is in the best interest of the community to preserve the integrity of the
election process by prohibiting false campaign statements; and
WHEREAS, for the foregoing reasons, the Council wishes to adopt an
ordinance prohibiting false statements relating to candidates or questions
submitted to the electors at any city election.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that Chapter 7 of the Code of the City of Fort Collins be, and hereby is amended,
by the addition of a new Article V to read as follows:
ARTICLE V. FALSE CAMPAIGN STATEMENTS
Sec. 7-136. False statements relating to candidates or
questions submitted to the electors.
No person shall knowingly make, publish or circulate or cause to
be made, published ory circulated in any letter, circular,
advertisement or poster, or in any other writing, any false
statement designed to affect the vote on any issue submitted to the
electors at any city election or relating to any candidate for
election to a city office.
Sec. 7-137. Penalties.
Any person who violates any of the provisions of this Article
shall be guilty of a misdemeanor punishable by a fine or by
imprisonment or both in accordance with Section 1-15.
Introduced, considered favorably on first reading, and ordered published
this 17th day of May, A.D. 1994, and to be presented for final passage on the 7th
day of June, A.D. 1994.
