Home My WebLink About078 - 06/20/1995 - AMENDING CITY CODE REGARDING ROOF COVERING REQUIREMENTS (FAILED TO PASS) OPTION A ORDINANCE NO. 78, 1995 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING SECTION 5-27 OF THE CODE OF THE CITY OF FORT COLLINS REGARDING ROOF COVERING REQUIREMENTS WHEREAS, at the request of the City Council, the Board of Directors of the Po'/File Authority, on April 25, 1995, reconsidered the provisions of Ordinance No. 189, 1994 (th Roofing Ordinance"), and determined that the Roofing Ordinance was enacted in the best i forest of the health and safety of the citizens of the City; and WHEREAS, the Board of Directors of the-Poudre Fire Authority furt /rdetenninedthatthe Code of the City should be amended to afford an additional period of fi} 5) years during which time any existing roof covering on any building classified as a Group R�, ivision 3 Occupancy may be replaced or covered with the same or similar materials having tf} same or higher classification as the existing roof covering, provided that the new replacer �ri roof covering should have a minimum rating of Class C; and WHEREAS, the Board of Directors of the Poud� ire Authority further recommended that, except for the addition of the aforesaid five (5) ye Y exception, the provisions of the Roofing Ordinance should continue in effect; and WHEREAS, the City Council has ermined that the recommendation of the Board of Directors of the Poudre Fire/1- RDAINED and and is in the best interest of the City. NOW, THEREFORE BY THE COUNCIL OF THE CITY OF FORT COLLINS, as follows: Section 1. That treby finds: (1) That in order to avoid the possibility of the imposition of an un _asonable hardship upon the owners-of existing-buildings-c assifierLas- "Group R, Division 3 �cupancy," such owners should be permitted to replace or cover existing roofs with the same r similar materials having the same or higher classification as the existing roof covering, provid that the new replacement roof covering should have a minimum rating of Class "C" until 20 7at which time such owners should be required to, when replacing or covering existing ro s, use only Class "A" materials. (2) That because of the limited number of existing homes ticipated to be re-roofed with other than Class "A" materials during the five year transition pen recommended by the Board of Directors of the Poudre Fire Authority, there will not be a si ificant increase in the City's overall risk of large fires in existing neighborhoods. Sec. 5-27. Amendments and deletions to code. (50) Section 3203(b) is amended by adding a third "Exception" to read as follows: T--Cc� 1p-d O Pass "I Until midnight December 31, 1999, any existing roof.covering on any building classified as a Group R,Division 3 Occupancy may be replaced or coffered with the same or similar materials having the same or higher classification as the existing roof covering, provided that the new replacement roof covering must have a minimum rating of Class C.'` Section 2. That the effective date of this Ordinance shall be July I, 1995. Mayor ATTEST: City Clerk / OPTION B ORDINANCE NO; 78; loos_ OF THE COUNCIL OF THE CITY OF FORT COLLI REPEALING ORDINANCE NO. 189, 1994 AN AMENDING SECTION 5-27 OF THE CODE OF THE CITY FORT COLLINS REGARDING ROOF COVERING REQUIR ENTS WHEREAS, in December, 1993, the Board of Direc rs of the Poudre Fire Authority, pursuant to Resolution 93-12, recommended prohibiting w d roofing within the fire protection boundaries of the Poudre Fire Authority; and WHEREAS, subsequent to the enactment of id Resolution, substantial public discussion of this proposed prohibition has occurred, with hear' gs having been held before the Larimer County Planning Commission,and Building Board of Ap als,the City's Natural Resources Advisory Board and Building Review Board and the Council's ealth and Safety Committee; and WHEREAS,on December 5, 1994 ue Board of Commissioners of Larimer County imposed a Class B roofing standard for the [no tainous areas of Larimer County and a Class C roofing standard for the remainder of unincor orated areas of Larimer County; and WHEREAS, the City's N, iral Resources Advisory Board has recommended to the Council that Class A roofing standards e adopted for the incorporated jurisdiction of the City; and WHEREAS, the Ci s Building Review Board has recommended that the Class B and Class C looting standards as em tiled by Larimer County be adopted for the incorporatedjurisdichon of the City; and WHEREA upon reconsideration,the Council has determined that the regulation established by Larimer Cou ty, requiring "Class B" shingles in mountainous areas and "Class C" shingles elsewhere, is r asonablc and adequately protects the public from the risk of fire; and W REAS, the Council has determined that it is desirable that roofing standards be uniform established in the City and the unincorporated areas of the County in order to aid and simpli compliance with and enforcement of law; and WHEREAS, in the interest of the protection of the public health, safety and welfare, and articut rly in the interest of protecting the public against the risk of injury, death and property damage caused by residential fires and the spreading of such fires, the Council has determined that Ordinance No. 189, 1994 of the Council should be repealed and that non-classified wood roofing materials should be prohibited within the City. NOW,THEREFORE, BE 1T ORDAINED BY THE COUNCIL FOR THE CITY OF FORT COLLINS, as follows: Section 1. That the Council hereby finds that: -Lo Pass a. Portions of the City_ of Fort Collins are located in the wildlands- urban interface area, in which area the risk of wildland fires increases the fire hazard risk for homes. b. The utilization of non-classified wood roofing significantly increases the risk of fire by reason of the combustion potential of such roofing. c. The utilization of non-classified wood roofing significantly increases the risk of spread of fire to adjoining properties by reason of the potential for wood roofing to emit burning embers. d. Ordinance No. 189, 1994,passed on February 7, 1995,excessively restricts the use of wood roofing materials. Section 2. That Ordinance No. 189, 1994 is hereby repealed in its entirety. Section 3. That Section 5-27 of the Code of the City is hereby amended by the addition of two new subsections, to be numbered as subsections (48) and(49) with the former subsections (48) and (49) and the remaining subsections renumbered accordingly; and that the new subsections (48) and (49) shall read as follows: Sec. 5-27. Amendments and deletions to code. (48) Commencing July 1, 1995, Section 3204.(e) "Special-purpose Roofs" is deleted in its entirety. (49) Commencing July I, 1995, Table No. 32-A, "Minimum Roof Classes" is amended to read as shown on Exhibit "A" attached hereto and incorporated herein by this reference.
