AMENDING CHAPTER 26 OF THE CITY CODE
RELATING TO NON-SUBSTANTIAL
MODIFICATIONS TO THE PRETREATMENT PROGRAM
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows:
Section 1 . That Section 26-53 of the Code of the City is hereby amended
to read as follows:
Sec. 26-53. Administrative appeal procedure.
Any permit applicant, permit holder or other water user affected
by any decision, action or determination made by the utility in
interpreting or implementing the provisions of this Article or any
programs developed under this Article may file an appeal in
accordance with the procedures set forth in §26-351.
Section 2. That Section 26-206 of the Code of the City is hereby amended
to read as follows:
Sec. 26-,206. Definitions.
industrial shall mean of or pertaining to industry,
manufacturing, commerce, trade or business as distinguished from
domestic or residential .
Significant noncompliance shall mean an industrial user who is in
violation of one (1) or more of the following criteria: . . . .
(2) Technical review criteria (TRC) violations, defined as
those in which thirty-three (33) percent or more of all
of the measurements for each pollutant parameter taken
during a six-month period equal or exceed the product
of the daily maximum limit or the average limit times
the applicable TRC (TRC = 1.4 for BOD, TSS, fats, oil
and grease and 1.2 for all other pollutants except pH) ; .
(4) Any discharge of a pollutant that has caused imminent
endangerment to human health, welfare or to the
environment or has resulted in the POTW's exercise of
its emergency authority under subparagraph (b) of §26-
344 of this Article to halt or prevent such a discharge.
Section 3. That Section 26-308(b) of the Code of the City is hereby
amended to read as follows:
Sec. 26-308. Industrial discharge permit: application.
(b) At least ninety (90) days prior to any discharge into the
wastewater utility, all significant industrial users shall complete
and file with the Director an application for an industrial
discharge permit in the form prescribed by the city accompanied by
any required filing fee. Other industrial users may be required to
complete and file with the Director an application for an industrial
discharge permit as described in this section if the Director has
reasonable grounds to believe that the user may be a significant
industrial user. In support of the application, the applicant shall
submit in units and terms appropriate for evaluation, the following
information: . . . .
