OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE SALE OF REAL PROPERTY AT
309 SOUTH SHERWOOD
WHEREAS, on April 17, 1985, Grace Quinby, a Fort Collins resident, donated
to the City her residence and lot situated at 309 South Sherwood ("the
Property") ; and
WHEREAS, Ms. Quinby's intent in making the donation was that the Property
be converted by the City to a "minipark" for senior citizens; and
WHEREAS, the City accepted the Property but subsequently determined that
it was not economically feasible to remove the residence from the Property or to
build a senior minipark on the site; and
WHEREAS, after consultation with the attorneys for the Quinby Estate, it
has been determined that the Property should be sold by the City and the proceeds
awarded, in the minimum amount of $55,000, to said estate; and
WHEREAS, the City has offered the Property for sale to the public, and the
highest bid received by the City for the Property is in the amount of $56, 150;
and
WHEREAS, Section 23-111 of the City Code requires that the Council
authorize the sale, conveyance or other disposition of any and all interests in
real property owned in the name of the City and first find, by ordinance, that
such sale or other disposition is in the best interests of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That the City Council hereby finds that the sale of the
Property is in best interests of the City.
Section 2. That the proposed sales price of the Property in the amount of
Fifty-six Thousand One Hundred Fifty Dollars ($56,150) represents the fair market
value of the Property.
Section 3. That the sale of the Property to Joseph Kane in the sum of
Fifty-six Thousand One Hundred Fifty Dollars ($56,150) is hereby approved by the
Council upon such terms and conditions as may be acceptable to the City Manager
and the City Attorney.
Section 4. That the proceeds of the sale of the Property, less costs
incurred by the City in selling the property up to a maximum of One Thousand One
Hundred Fifty Dollars ($1,150), are to be paid over to the law firm of March and
Myatt, as Trustee for the estate of Grace Quinby.
