OF THE COUNCIL OF THE CITY OF FORT COLLINS
ADOPTING CROSS-CONNECTION CONTROL RULES AND
REGULATIONS PURSUANT TO SECTION 26-189 OF
THE CODE OF THE CITY OF FORT COLLINS
WHEREAS, Section 26-189 of the Code of the City of Fort Collins authorizes
and directs the City Manager to establish a program to control and eliminate
cross-connection- hazards- ("the- Program") :- and-
WHEREAS, Section 26-189 provides that the City Council may, upon
recommendation of the City Manager, adopt by ordinance such supplemental rules
and regulations as may be necessary to implement and administer the Program; and
WHEREAS, the City Manager and City staff have developed for the purposes
of implementing and administering the Program a "Cross Connection Control Manual "
("the Manual ") , which contains the cross-connection control rules and regulations
which the City Manager is recommending that the Council adopt in this Ordinance
("the Rules and Regulations") ; and
WHEREAS, three (3) copies of the Manual are currently on file with the City
Clerk for review and inspection by the public; and
WHEREAS, on May 20, 1994, at its regular meeting, the Water Board reviewed
the Rules and Regulations and found their requirements to be reasonable in light
of state and federal laws governing the quality of water supplied to customers
by public water systems, and therefore the Board has recommended that City
Council adopt by ordinance the Rules and Regulations; and
WHEREAS, tine- Rubs and- Regulations are- n-L-ces-sary try order- to protect the
City's potable water system from contamination, thereby protecting the health,
safety, and welfare of the citizens of Fort Collins and the users of the City's
potable water system.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1 . That Council finds that the Rules and Regulations are necessary
in order to protect the City's potable water system from contamination, thereby
protecting the health, safety, and welfare of the citizens of Fort Collins and
the users of the City's potable water system.
Section 2. That pursuant to Section 26-189 of the City Code the Rules and
Regulations are hereby adopted and approved by the Council for the purposes of
implementing and administering the Program.
Section 3. That pursuant to Section 26-189 it shall be unlawful for any
person to violate any provision of the Rules and Regulations, and any person
convicted of violating any provision of the Rules and Regulations shall be
subject to punishment as provided in Section 1-15 of the City Code.
Section 4. That the City Clerk is hereby directed to maintain hereafter
in the Clerk's office three (3) copies of the Manual , and any subsequent
amendments thereto, for review and inspection by the public.
