OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY TO SELL VARIOUS FARM BUILDINGS LOCATED
AT 4700 HINSDALE DRIVE AND APPROVItrATING UNANTICIPATED REVENUE
INTO THE PARKLAND FUND
WHEREAS, the City of Fort Collins is the owner of a ten acre undeveloped
park- site adjacent to McGraw Elementary School- located at4700- Hinsdale- Drive
("the Park Property") ; and
WHEREAS, the Park Property has 14 small farm buildings (the "Farm
Buildings") located on it that must be removed before the park is developed; and
WHEREAS, the City has solicited and received bids to sell the Farm
Buildings and have them removed from the Park Property; and
WHEREAS, the bidders providing the most favorable bids for the Farm
Buildings, the amounts of the bids and a description of the Farm Buildings are
shown on Exhibit "A," attached hereto and incorporated herein by this reference;
and
WHEREAS, Section 23-111 of the City Code provides that the City Council is
authorized to sell , convey or otherwise dispose of real property owned by the
City, provided the Council first finds by ordinance that any sale or disposition
of the real property is in the best interests of the City; and
WHEREAS, Council 's authorization to sell the Farm Buildings to the bidders
listed on Exhibit "A" will result in a net gain to the City of $2,082 and will
cause the buildings to be removed from the Park Property at no cost to the City;
and
WHEREAS, Article V, Section 14, of the Charter of the City of Fort Collins
authorizes the City Council to appropriate revenues which are the result of new
revenue sources at any time during the year in which such revenue is received.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That the sale of the Farm Buildings to the bidders and for the
amounts as shown on Exhibit "A" is in the best interests of the City of Fort
Collins.
Section 2. That the City Manager or his designee is authorized to execute
agreements and other documents of conveyance necessary to convey the Farm
Buildings to the bidders and for the amounts as shown on Exhibit "A," resulting
in a net gain to the City of Two Thousand Eighty-two Dollars ($2,082) .
Section 3. That there is hereby appropriated for expenditure from
unanticipated revenue in the Parkland Fund the sum of Three Thousand Eight
Hundred and Thirty-two Dollars ($3,832) to be used for Parkland Fund purposes.
Introduced, considered favorably on first reading, and ordered published
this 2nd day of August, A.D. 1994, and to be presente for final pas age on the
16th day of August, A.D. 1994.
