OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY TO GRANT A NON-EXCLUSIVE UTILITY
EASEMENT FOR A GAS LINE TO PUBLIC SERVICE COMPANY OF COLORADO
AND APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND
FOR THE CHOICES 95 OLDER ADULT CENTER PROJECT
WHEREAS, the City of Fort Collins is the owner of the Tand known as the
Fort Collins Senior Center P.U.D. in Larimer County, Colorado; and
WHEREAS, the Public Service Company of Colorado wishes to acquire a non-
exclusive easement interest in the property as described on Exhibit "A," attached
hereto and incorporated herein by this reference, to construct, operate,
maintain, repair and replace a gas line;
WHEREAS, Section 23-111 of the City Code provides that the City Council is
authorized to sell , convey or otherwise dispose of real property owned by the
City, provided the Council first finds by ordinance that any sale or disposition
of real property owned by the City is in the best interest of the City of Fort
Collins; and
WHEREAS, the value of the easement, based on comparable sales in the areas,
is $2,150; and
WHEREAS, consideration for the aforementioned easement will result in
unanticipated revenue in the Capital Projects Fund, Older Adult Center capital
project; and
WHEREAS, Article V, Section 14, of the Charter of the City of Fort Collins
authorizes the City Council to appropriate unanticipated revenues which are the
result of new revenue sources at any time during the year in which such revenue
is received.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1 . That the above-described sale and conveyance of an easement
interest is in the best interest of the City of Fort Collins.
Section 2. That the Mayor is authorized to execute an agreement conveying
a non-exclusive easement interest for a gas line to Public Service Company of
Colorado over, on, and under the real property described on Exhibit "A", for the
amount of TWO THOUSAND ONE HUNDRED FIFTY DOLLARS ($2,150) .
Section 3. That there is hereby appropriated for expenditure from
unanticipated revenue in the Capital Projects Fund, Older Adult Center project,
the sum of TWO THOUSAND ONE HUNDRED FIFTY DOLLARS ($2,150) to be used with
previously appropriated funds for the Choices 95 Older Adult Center project.
Introduced, considered favorably on first reading, and ordered published
this 19th day of July, A.D. 1994, and to be presented for final passage on the
2nd day of August, A.D. 1994.

LEGAL DESCRIPTION - GAS LINE EASEMENT
FORT COLLINS SENIOR CENTER P.U.D.
FORT COLLINS, COLORADO
Beginning at the Northeast corner of the Fort Collins Senior Center P.U.D. , City
of Fort Collins, County of Larimer, State of Colorado, according to the recorded
plat thereof:
Thence South 00 degrees 21 minutes 00 seconds East, 286.74 feet; thence along a
non-tangent curve to the left having a delta of 02 degrees 05 minutes 50 seconds,
a radius of 274.00 feet an arc of 10.03 feet and a chord which bears South 85
degrees 19 minutes 27 seconds West, 10.03 feet; thence North 00 degrees 21
minutes 00 seconds West, 287.58 feet; thence South 89 degrees 53 minutes 30
seconds East, 10.00 feet to the Point of Beginning of this description. Said Gas
Line Easement contains 2,871.00 square feet, more or less.
