OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING THE CODE OF THE CITY OF FORT COLLINS
PERTAINING TO THE FUNCTIONS OF THE LIBRARY
BOARD AND LIBRARY REGULATIONS
WHEREAS, the Library Board has examined the functions as established in
Section 2-293 of the Code of the City and has determined that said functions are,
in some respects, obsolete and/or redundant and has recommended that said
functions be revised; and
WHEREAS, Sections 23-171 and 23-172 should be revised to provide for the
establishment of library rules and regulations by the Library Director rather
than the Library Board by reason of the fact that the Library Board serves in a
strictly advisory capacity.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the Code of the City be amended as follows:
Section 1. That Section 2-293 of the Code of the City is hereby amended
so as to read as follows:
Sec. 2-293. Functions.
The board shall serve in an advisory capacity to the City Council
on all issues pertaining to the public library. The board shall
have the following authority:
(1) To advise the City Council and staff on such policies,
rules and regulations and other matters as the board
believes necessary and proper for the administration,
management and development of the public library and its
facilities; and
(2) To take such actions as the board believes necessary and
proper to encourage the making of grants or gifts in
support of the public library.
Section 2. That Sections 23-171 and 23-172 of the Code of the City are
hereby amended to read as follows:
Sec. 23-171. Regulations.
The public library shall be free for the use of the residents of
the city subject to reasonable rules and regulations adopted by the
Library Director.
Sec. 23-172. Violation of rules and regulations.
It shall be unlawful for any person to fail to return any book or
material belonging to the library in accordance with the rules and
regulations adopted by the Library Director or to otherwise
knowingly violate such rules and regulations.
Introduced, considered favorably on first reading, and ordered published
this 3rd day of December, A.D. 1991 , and to be presented for final passage on the
17th day of December, A.D. 1991 .
