OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING SECTIONS 29-372, 29-419 AND
29-526(F) (2) (c) AND (5) (a) PERTAINING TO
THE REFERRING OF DECISIONS
BY THE DIRECTOR OF PLANNING TO THE
PLANNING AND ZONING BOARD
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS, that the
Code of the City be amended as follows:
Section 1 . That the last sentence of Section 29-372 be amended to
provide as follows:
Notwithstanding the foregoing, the Director of Planning may refer
the decision to the Planning and Zoning Board, and if so
referred, the decision of the Planning and Zoning Board shall
constitute a final decision, subject only to appeal to the City
Council as provided in Section 2-47 of the Code.
Section 2. That the last sentence of Section 29-419 be amended to
provide as follows:
Notwithstanding the foregoing, the Director of Planning may refer
the decision to the Planning and Zoning Board, and if so
referred, the decision of the Planning and Zoning Board shall
constitute a final decision, subject only to appeal to the City
Council as provided in Section 2-47 of the Code.
Section 3. That Section 29-526(F) (2) (c) be amended to provide as
follows:
This section allows for changes to a master plan. Minor changes
to a master plan may be approved administratively by the Director
of Planning. Such changes may be authorized without additional
public hearings, at the discretion of the Director of Planning.
Notwithstanding the foregoing, the Director of Planning may refer
the decision to the Planning and Zoning Board, and if so
referred, the decision of the Planning and Zoning Board shall
constitute a final decision, subject only to appeal to the City
Council as provided in Section 2-47 of the Code.
Section 4. That Section 29-526(F) (5) (a) be amended to provide as
follows:
Minor changes to a planned unit development may be approved
administratively, by the Director of Planning, whereupon a permit
may be issued. Such changes may be authorized without additional
public hearings, at the discretion of the Director of Planning.
Notwithstanding the foregoing, the Director of Planning may refer
the decision to the Planning and Zoning Board, and if so
referred, the decision of the Planning and Zoning Board shall
constitute a final decision, subject only to appeal to the City
Council as provided in Section 2-47 of the Code.
Introduced, considered favorably on first reading, and ordered
published this 3rd day of July, A.D. 1990, and to be presented for final
passage on the 17th day of July, A.D. 1990.
