ORDINANCE NO. 117, 1990 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE EXCHANGE OF REAL PROPERTIES BETWEEN THE CITY OF FORT COLLINS AND MIDOU ENTERPRISES, U.S.A. , INC. WHEREAS, The City of Fort Collins ("the City") and Midou Enterprises, U.S.A. , Inc. ("Midou") have entered into an Agreement of Exchange of Real Property, dated October 16, 1990 ("the Agreement") ; and WHEREAS, pursuant to the Agreement, the City has agreed to deed to Midou 0.544 acres of the City's real property located at the SouthRidge Golf Course ("the City Property") ; and WHEREAS, in return, Midou has agreed to deed to the City 0.544 acres of Midou's real property that is located adjacent to the SouthRidge Golf Course ("the Midou Property") ; and WHEREAS, these exchanges of real properties equally improve the land usages at the SouthRidge Golf Course and on Midou's adjacent development property; and WHEREAS, the Agreement is contingent upon City Council 's approval of the Agreement on or before November 6, 1990; and WHEREAS, Section 23-111 of the Code of the City of Fort Collins requires the Council to find that any proposed conveyance of City real property is in the best interests of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That the conveyance of the City Property in exchange for the Midou Property is in the best interests of the City of Fort Collins. Section 2. That the Agreement is hereby approved. Section 3. That the Mayor be, and hereby is, authorized to execute deeds conveying the City property to Midou, pursuant to the terms and subject to the contingencies contained in the Agreement. Introduced, considered favorably on first reading, and ordered published this 16th day of October, A.D. 1990, and to be presented for final passage on the 6th day of November, A.D. 1990.
