OF THE COUNCIL OF THE CITY OF FORT COLLINS
CONSENTING TO THE CONSTRUCTION OF CERTAIN STREET
IMPROVEMENTS AND THE INCLUSION OF CERTAIN PROPERTY
WITHIN THE CORPORATE BOUNDARIES OF THE CITY IN
A SPECIAL IMPROVEMENT DISTRICT TO BE
CREATED BY LARIMER COUNTY,
COLORADO
WHEREAS, the Board of Commissioners of Larimer County, Colorado, has
adopted a resolution evidencing its intention to initiate the "Larimer
County, Colorado Consolidated Local Improvement District No. 1990-1" (the
"District") for the purpose of making certain street improvements; and
WHEREAS, the legal description of the District is described in Exhibit
"A" attached hereto and the nature of the improvements to be made within
the District are described in Exhibit "B" hereto; and
WHEREAS, that portion of the District described in Exhibit "C" hereto
is within the municipal boundaries of the City of Fort Collins ("the
City") ; and
WHEREAS, Section 30-20-603(1) (a) , C.R.S. , requires that the City
consent to such improvements within its municipal boundaries prior to such
improvements being made; and
WHEREAS, it is the opinion of the City Council that the inclusion of
such improvements in the proposed District is in the best interests of the
City, and the Council desires to consent to the same; and
WHEREAS, by passage of this ordinance, the City Council does not
intend that the City shall in any way participate in any of the costs of
the improvements to be constructed in the District; and
WHEREAS, by passage of this ordinance, the City Council does not
intend that any subsequent development of property in the District which
lies within the corporate boundaries of the City shall be exempt from
compliance with all applicable City standards and requirements.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the City hereby consents to the construction of the
street improvements described in Exhibit "B" hereto to be made within the
District, including that portion of the District within the boundaries of
the City, as more particularly described in Exhibit "C" hereto.
Section 2. That the City hereby consents to the inclusion of the
property described in Exhibit "C" in the District.
Introduced, considered favorably on first reading, and ordered
published this 4th day of September, A.D. 1990, and to be presented for
final passage on the 18th day of SepteZb A.D. �1990.

EXHIBIT B
1. Nature of Improvements:
(a) Fairway Estates Assessment Unit. Improvements proposed
for the Consolidated Local Improvement District No. 1990-1,
Fairway Estates Assessment Unit, will consist of rehabilitation
of the existing asphalt paved streets. Areas of pavement failure
will be excavated and replaced with new full depth asphalt
patches. Areas of extensive pavement cracking will be sealed and
overlaid or reconstructed as necessary. Minor cracks in the
existing pavement surface will be sealed and overlaid with
asphalt mat. A hot mix asphalt mat surface course will be placed
over the repaired or reconstructed surfaces. The asphalt overlay
course will be designed to accommodate anticipated traffic
loading on a local street. The finish grade of the asphalt
surface will be crowned to achieve proper drainage across the
pavement surface. Improvements will include any necessary
facilities to provide positive storm water drainage away from the
pavement surface. No significant changes in horizontal or
vertical alignment of the street surface are anticipated.
(b) Pheasant Run Assessment Unit. Improvements proposed
for the Consolidated Local Improvement District No. 1990-1,
Pheasant Run Assessment Unit, will include complete
rehabilitation of the existing asphalt paved streets. All of the
existing streets, excepting the stub extension of Meining Road,
will be improved. The improvements will consist of
rehabilitation of the existing asphalt paved surface. An asphalt
mat overlay will be placed over the existing pavement surface.
The asphalt overlay course will be designed to accommodate
anticipated traffic loading on a local street. The finish grade
of the asphalt surface will be crowned in order to eliminate any
ponding of water on the pavement surface. New driveway culverts
would be placed at each location where there is currently a
nonexistent or undersized drive culvert. Prior to placement of
the overlay, areas of pavement failure would be excavated and
replaced as necessary with new material to rebuild a load bearing
surface beneath the new asphalt overlay. The vegetation and
shoulder material at the sides of the existing asphalt surface
will be removed and replaced as necessary with gravel road base
material to supply a load bearing shoulder with improved
drainage. The new gravel shoulder would be placed to match the
heightened grade of the asphalt surface after placement of the
overlay. Gravel road base material would also be placed as
necessary at driveway entrances to improve the entrances and to
meet the grade of the new asphalt surface.
The foregoing descriptions of improvements to be made within
the District are approximate and are subject to further
refinement and specification.
2 . Streets to be Improved:
The streets to be improved shall include the following:
Pheasant Run Assessment Unit:
(a) Meining Road from County Road 21 easterly a
distance of 3 , 453 . 21 feet to the intersection of Pheasant Run.
(b) Pheasant Run from the intersection of Meining Road
south a distance of 828 . 10 feet to the south line of Lots 8 and 9
in Pheasant Run Subdivision.
(c) Burger Drive from the intersection of Meining Road
northeasterly a distance of 800. 00 feet more or less to the end
of the road.
Fairway Estates Assessment Unit:
(a) Fairway Lane from the east edge of the service
road east and north 1, 971. 00 feet to the south edge of the
asphalt on Palmer Drive.
(b) Palmer Drive from the east edge of the service
road easterly 3 , 004 . 00 to the west edge of the asphalt on Hogan
Drive, excepting that portion on the dam embankment which is to
be improved by the City of Fort Collins at the time of dam
reconstruction.
(c) Hogan Drive from the south gutter flowline of
Harmony Road southerly 2 , 475. 00 feet to the south line of Fairway
Estates.
(d) Player Drive from the east edge of the asphalt on
Hogan Drive northerly 900. 00 feet to the end of the loop in the
