HomeMy WebLinkAbout003 - 02/05/1985 - AMENDING ORDINANCE NO. 056, 1986 TO CHANGE THE ZONING CONDITIONS ON THE PROPERTY KNOWN AS SCENIC VIE ORDINANCE NO. 3 , 1985 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING ORDINANCE NO. 56, 1980 TO CHANGE THE ZONING CONDITIONS ON THE PROPERTY KNOWN AS SCENIC VIEWS P.U.D. WHEREAS , on May 20, 1980, the Council of the City of Fort Collins passed, on second reading, Ordinance No. 56, 1980; and WHEREAS, Ordinance No. 56, 1980 zoned the Scenic Views P.U.D. as R-P, Planned Residential , with a condition limiting density to 8.5 DU/acre and with a condition restricting the commercial allotment to 40 sq. ft./DU; and WHEREAS, factors present at the time these conditions were placed on the property have substantially changed as a result of the adoption of the Land Development Guidance System; and WHEREAS, the elimination of these conditions will allow development consistent with the Land Development Guidance System; and WHEREAS, City staff requested the Planning and Zoning Board to recom- mend approval to the City Council of the request to eliminate the density limitation and the commercial allotment restriction ; and WHEREAS, on December 17, 1984, the Planning and Zoning Board voted 7-0 to recommend approval of this request ; and WHEREAS, the owner of the property, Blair Kiefer, has approved this request. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Ordinance No. 56, 1980 be , and it hereby is , amended as follows: Section 1. That the density limitation condition of 8.5 DU/acre on the property known as the Scenic Views P.U.D. is eliminated. Section 2. That the commercial allotment permitted in Planned Unit Developments is eliminated. Introduced, considered favorably on first reading, and ordered pub- lished this 15th day of January , A.D. 1985, and to be presented for final passage on the 5th day of February , A.D. 1985.
