OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING SECTION 29-1 (ZONING DEFINITIONS) , SECTION 29-368(7)
(I-L/I-P PERFORMANCE STANDARDS) AND SECTION 29-526 (LAND
DEVELOPMENT GUIDANCE SYSTEM) OF THE CODE OF THE CITY
OF FORT COLLINS RELATING TO HAZARDOUS MATERIALS
WHEREAS, the Council of the City of Fort Collins has determined that there
is a growing risk of hazardous materials in Fort Collins; and
WHEREAS, the Council has determined that locating new facilities and uses
so that they will not adversely impact existing adjacent or future land uses
reduces community risk; and
WHEREAS, the Council has determined that a hazardous materials impact
analysis is an important tool to use in evaluating the level of hazardous
materials risk.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1 . That Section 29-1 of the Code of the City of Fort Collins is
hereby amended to add the following definition:
Sec. 29-1. Definitions.
Hazardous materials shall mean those chemicals or substances
which are physical or health hazards as defined and classified in
the Fire and Building Codes. Hazardous materials categories include
explosives and blasting agents, compressed gases, flammable and
combustible liquids, flammable solids, organic peroxides, oxidizers,
pyrophoric materials, unstable (reactive) materials, water reactive
solids and liquids, cryogenic fluids, highly toxic and toxic
materials, radioactive materials, corrosives, carcinogens,
irritants, sensitizers and other health hazards. Each category is
defined separately in the Fire and Building Codes in accordance with
the Code of Federal Regulations Title 29 and other nationally
recognized standards.
Section 2. That Section 29-368 of the Code of the City of Fort Collins
is hereby amended by the addition of a new subparagraph (7) to read as follows:
Sec. 29-368. Performance standards.
(7) Hazardous materials. If the proposed uses or tenants
of the project are known to use and/or store hazardous
materials (including hazardous wastes) on-site, the
project shall be designed to comply with all fire and
building codes for the hazardous materials use and
adequate precautions shall be taken to protect against
negative off-site impacts of a hazardous materials
release, using best available technology. A hazardous
materials impact analysis, conforming to the
requirements of the Poudre Fire Authority, shall be
required to determine potential off-site impacts and
required mitigation precautions.
Section 3. That Section 29-526(D) , All Development Activity Chart,
Environmental Standards, of the Code of the City of Fort Collins is hereby
amended by the addition of the following Criterion 26, with all following
Criteria to be renumbered accordingly:
26. If the proposed uses or tenants of the project are known to
use and/or store hazardous materials (including hazardous
wastes) on-site, has the project been designed to comply with
all fire and building codes for the hazardous materials use
and have adequate precautions been taken to protect against
negative off-site impacts of a hazardous materials release,
using best available technology? A hazardous materials impact
analysis, conforming to the requirements of the Poudre Fire
Authority, shall be required to determine potential off-site
impacts and required mitigation precautions.
Section 4. That Section 29-526(G) (3) (a) of the Code of the City of Fort
Collins is hereby amended by the addition of a new subparagraph [7] , to read as
follows:
[7] Hazardous Materials Impact Analysis. This analysis shall be
required for all development proposals that have potential
off-site hazardous materials impacts. The analysis shall
conform to the requirements of the Poudre Fire Authority.
Introduced, considered favorably on first reading, and ordered published
this 6th day of August, A.D. 1991, and to be presented for final passage on the
20th day of August, A.D. 1991 .
