OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE GRANTING OF AN ACCESS
EASEMENT FROM THE CITY OF FORT COLLINS
TO PLATTE RIVER POWER AUTHORITY
WHEREAS, the Platte River Power Authority ("PRPA") has requested the City
of Fort Collins ("the City") to grant it a 15-foot easement to provide PRPA
access to their electrical transmission line in the Southridge Greens P.U.D. ,
Phase I ; and
WHEREAS, the access easement requested by PRPA is legally described in
Exhibit "A" attached hereto and incorporated herein by reference, which easement
shall be hereinafter referred to as "the Easement" ; and
WHEREAS, Section 23-111 of the Code of the City of Fort Collins authorizes
the City Council to sell , convey or otherwise dispose of any and all interests
in real property owned in the name of the City, provided that the Council first
finds that such sale or other disposition is in the best interests of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
1 . That the granting of the Easement by the City to PRPA is in the best
interests of the City.
2. That the Mayor be, and hereby is, authorized to execute such
instruments as are necessary for the City to grant and convey the Easement to
PRPA.
Introduced, considered favorably on first reading, and ordered published
this 15th day of January A.D. 1991 , and to be presented for final passage on the
5th day of February A.D. 1991 .

EXHIBIT "A"
An access easement on, over and across portions of Tract B-1 of Southridge Greens
P.U.D. Phase 1 located in the Northwest quarter of Section 7, Township 6 North,
Range 68 West, of the 6th P.M. of Larimer County, Colorado, being more
particularly described as follows:
That portion of an easement 15.0 feet in width located on the subject parcel with
foreshortened and prolonged sidelines to meet the property lines of the parcel
and shall be 7.5 feet each side measured at right angles and parallel with the
centerline described as follows:
Considering the West line of the said Northwest Quarter of Section 7 as bearing
North 00°02'43" East and with all bearings contained herein relative thereto:
Commencing at the Northwest corner of said Section 7: thence along the North
line of said Northwest Quarter, North 89°34'23" East, 2245.38 feet; thence South
00'02'43" West, 448.77 feet to the boundary of "Southridge Greens P.U.D. - Phase
I" as recorded in Book 2235 Page 1230, Larimer County Records; thence along said
boundary, South 35000'00" East, 44.38 feet to the POINT OF BEGINNING of said
centerline; thence along said Centerline, South 61°56'26" East, 208.34 feet to
the Westerly right-of-way of Union Pacific Railroad, said point being the
terminus of said Centerline.
The above described easement contains 3125 square feet, more or less and is
subject to all easements and rights-of-way now on record or existing.
