AMENDING CHAPTER 3A OF THE CODE OF THE
CITY OF FORT COLLINS TO INCLUDE APPEALS OF
�. THE DECISIONS OF THE MASSAGE LICENSING AUTHORITY AND
AMENDING SECTION 73-143(D) TO BRING SAID SECTION INTO
\ COMPLIANCE WITH CHAPTER 3A
WHEREA the City' s Massage Therapy Code provides for appeals from
decisions o the Massage Licensing Authority to be heard by the City
Council ; and
WHEREAS, Cha er 3A of the City Code pertaining to appeals does not
presently include aright of appeal from the Massage Licensing Authority;
and \\
WHEREAS, the Coun�41 does hereby determine that it is in the best
interests of the citizens of the City that such appeals be heard by the
Council and that the Code ''of the City should be made internally consistent
to allow for the hearing of appeals from the Massage Licensing Authority.
NOW, THEREFORE, BE IT OR9AINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That Section 73-�43(1)) of the Code of the City of Fort
Collins be repealed and readopted as follows:
§73-143. Massage Licensing Author\jty; membership; duties.
D. Any person in interest shalt,, have the power to appeal a
decision of the Authority to ''the City Council , provided
that such person in interest files with the City Clerk a
notice of appeal within fourteen ( 14) days after final
action by the Authority. The appeal shall be determined
pursuant to the provisions of Chapter 3A of this Code.
Section 2. That Section 3A-1 of Chapter 3A of\the Code of the City be
amended by the inclusion therein of appeals of the decisions of the Massage
Licensing Authority, so as to read as follows:
§3A-1. Certain appeals to be taken to City Council .
Appeals from the following boards and commissions;,\permitted
under the provisions of this chapter, shall be taken to'the City
Council in the manner as set forth herein:
A. Building Board of Appeals.
B. Fire Board of Appeals.
C. Landmark Preservation Commission.
D. Building Contractors Licensing Board.
E. Planning and Zoning Board.
F. Storm Drainage Board.
G. Zoning Board of Appeals.
H. MASSAGE LICENSING AUTHORITY.
Introduced, considered favorably on first reading, and ordered
published this 7th day of January, A.D. 1986, and to be presented for final
passage on the 21st day of January, A.D. 1986.
