OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING FOOTHILLS PARKWAY
BETWEEN MATHEWS STREET AND STANFORD ROAD
WHEREAS, the City of Fort Collins has been petitioned by Everwest
Partnership as an Owner and Developer of the Foothills Fashion Mall to
vacate a portion of Foothills Parkway described more particularly below for
a proposed expansion of the Mall ; and
WHEREAS, City staff has made all the necessary arrangements with the
Developer to provide adequate vehicle and pedestrian traffic circulation
through the Foothills Mall and surrounding neighborhoods; and
WHEREAS, City Departments and Utility Companies have been contacted
and have no problems with the vacation; and
WHEREAS, all necessary utility and public access easements will be
provided by the Developer; and
WHEREAS, there will be no costs to the City in making the proposed
change in public Right-of-Way; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1 . That the portion of Foothills Parkway between Mathews
Street and Stanford Road, recorded with the Larimer County Clerk and
Recorder described more particularly as follows, to wit:
A part of Foothills Parkway 4 located in Southmoor Village Fifth
Filing, City 'of Fort Collins, County of Larimer, State of
Colorado, which begins at the south radius point at the southwest
corner of Foothills Parkway and Stanford Road and run thence
along the arc of a 15.00 foot radius curve to the left a distance
of 23.56 feet, the long chord of which bears N 28*24' W 21.21
feet; thence N 73*24' W 294.78 feet; thence along the arc of a
856.53 foot radius curve to the left a distance of 251.40 feet,
the long chord of which bears N 81°48'30" W 250.50 feet; thence S
89*47' W 546.29 feet; thence along the arc of a 260.77 foot
radius curve to the left a distance of 206.63 feet, the long
chord of which bears S 67005' W 201 .27 feet; thence N 44*23' E
195.64 feet; thence along the arc of a 75.79 foot radius curve to
the left a distance of 59.00 feet, the long chord of which bears
N 22*05' E 57.52 feet; thence along the arc of a 15.00 foot
radius curve to the left a distance of 24.02 feet, the long chord
of which bears S 46005'30" E 21 .53 feet; thence along the arc of
a 360.77 foot radius curve to the right a distance of 11 .02 feet,
the long chord of which bears N 88054'30" E 11 .02 feet; thence N
89*47' E 546.29 feet; thence along the arc of a 956.53 foot
radius curve to the right a distance of 280.75 feet, the long
chord of which bears S 81°48'30" E 279.74 feet; thence S 73'24' E
294.25 feet; thence along the arc of a 15.00 foot radius curve to
the left a distance of 23.99 feet, the long chord of which bears
N 60°47' 15" E 21 .51 feet; thence along the arc of a 1319.21 foot
radius curve to the right a distance of 37.42 feet, the long
chord of which bears S 15°44'36" W 37.42 feet; thence S 16*36' W
93.03 feet to the point of beginning, containing 120,115 square
feet.
be, and the same hereby is vacated, abated and abolished.
Section 2. That this Ordinance shall become effective on June 9,
1988.
Introduced, considered favorably on first reading, and ordered
published this 4th day of August, A.D. 1987 and to be presented for final
passage on the 17th day of May, A.D. 1988.
