OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING PRIOR YEAR RESERVES IN THE GENERAL FUND AND
AUTHORIZING THE TRANSFER OF APPROPRIATED AMOUNTS
FROM THE GENERAL FUND TO THE CAPITAL PROJECTS FUND
WHEREAS, Article V, Section 8 of the Charter of the City of Fort
Collins authorizes the Council to provide by ordinance for payment of any
expense from prior year reserves at any time such reserves are available;
and
WHEREAS, Article V, Section 15 of the Charter of the City of Fort
Collins authorizes the Council to transfer unexpended, appropriated amounts
from one fund to another upon the recommendation of the City Manager,
provided that the purpose for the initial expenditure of said funds no
longer exists; and
WHEREAS, the City's program of street maintenance was previously
funded from revenues generated by the Transportation Utility Fee; and
WHEREAS, said funds have become unavailable to the City by reason of
order of the Larimer County District Court, dated June 4, 1987; and
WHEREAS, the City wishes to continue the street maintenance program;
and
WHEREAS, $234,000 is available from General Fund revenue reserves to
be used for local street maintenance; and
WHEREAS, staff wishes to combine the local street maintenance and
street rehabilitation program in the Capital Projects Fund to facilitate
the 1987 street maintenance effort; and
WHEREAS, the City Manager has reviewed and recommended the transfer of
a portion of said reserves to the Capital Projects Fund.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That there is hereby appropriated for expenditure from
prior year reserves in the General Fund the total sum of TWO HUNDRED THIRTY
FOUR THOUSAND DOLLARS ($234,000) for transfer to the Capital Projects Fund.
Section 2. That TWO HUNDRED THIRTY FOUR THOUSAND DOLLARS ($234,000)
is hereby transferred from the General Fund to the Capital Projects Fund,
and appropriated for expenditure in the Transportation Fund for the local
street maintenance program.
Section 3. That the immediate adoption of this ordinance is necessary
to preserve, protect and advance the general welfare of the residents of
the City of Fort Collins and to permit the City to immediately contract for
local street maintenance and to thereby protect City property; therefore,
the Council hereby determines that an emergency exists requiring the
immediate passage of this ordinance; and this ordinance is therefore,
enacted pursuant to Section 6 of Article II of the Charter of the City of
Fort Collins as an emergency ordinance and shall be effective upon its
passage.
Introduced, considered favorably by six members of the Council of
the City of Fort Collins and finally passed as an emergency ordinance and
ordered published this 14th day of July, A.D. 1987.
