OF THE COUNCIL OF THE CITY OF FORT COLLINS
PARTIALLY ELIMINATING THE DISTANCE RESTRICTIONS
FOR HOTEL AND RESTAURANT LIQUOR LICENSES
AS IMPOSED BY C.R.S. §12-47-138(1)(d)
WHEREAS, by Act of the General Assembly of the State of Colorado
entitled Senate Bill 112, which Act became effective on July 1, 1984, the
City Council may eliminate or reduce the distance restrictions imposed by
C.R.S. §12-47-138(1)(d) for hotel and restaurant liquor licenses , or may
eliminate one or more types of schools or campuses from the application of
any distance restriction established by or pursuant to said statutory
provision for hotel and restaurant liquor licenses; and
WHEREAS, the Liquor Licensing Authority of the City of Fort Collins
has recommended to the City Council that said distance restrictions be
eliminated with respect to any property owned by the State Board of
Agriculture for the benefit and use of Colorado State University; and
WHEREAS, the Council of the City of Fort Collins has considered the
recommendation of the Liquor Licensing Authority and does hereby determine
that said recommendation is in the pest interest of the citizens of -the
City and ought to be adopted by the Council by ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the distance restrictions as imposed by C.R.S. §12-47-
138(1)(d) (prohibiting the sale of liquor within 500 feet of any public or
parochial school ; or the principal campus of any college, university or
seminary) be eliminated for hotel and restaurant liquor licenses only, and
only with respect to properties owned by the State Board of Agriculture for
the benefit and use of Colorado State University. Except as said distance
restrictions are hereby eliminated with respect to properties of Colorado
State University (and with respect to hotel and restaurant licenses only)
said distance restrictions shall continue in full force and effect as they
pertain to any other public or parochial school ; or the principal campus of
any other college, university or seminary.

final passage on the 1st day of October, A.D. 1985.
