OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING ALL EASEMENTS EXCEPT THE EXISTING ELECTRICAL
EASEMENT OF THE MEADOWS AT REDWOOD P.U.D. , PHASE I
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate all easements except the existing electrical easement located at
The Meadows at Redwood, P.U.D. , Phase I set forth in more particular below;
and
WHEREAS, the owners of the property are in the process of replatting
all of The Meadows at Redwood, P.U.D. , Phase I and a portion of Redwood
Village P.U.D. , Phase II into single family lots; and
WHEREAS, all easements except the existing electrical easement
dedicated on the original plat need to be vacated to accommodate the
configuration of building lots on said replat; and
WHEREAS, all utilities are currently installed in the easements to be
dedicated to replace those vacated by this Ordinance and the utility
companies have been contacted and expressed no objections to the vacation;
and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that all easements located on the plat of The Meadows at Redwood
P.U.D. , Phase I except that electrical easement as shown on the westerly
side of the plat recorded in Book 2125 at page 744-750 of the records of
the Larimer County Clerk and Recorder described more particularly as
follows, to wit:
A tract of land located in the Southeast quarter of Section 1,
Township 7 North, Range 69 West, of the 6th P.M. of Larimer
County, Colorado, being a portion of the Plat of Redwood Village
P.U.D. , Phase II, a Plat of record with the Clerk and Recorder of
the said Larimer County, more particularly described as follows:
Considering the East line of the Northeast quarter of said
Section 1 as bearing North 00004'13" West and with all bearings
contained herein relative thereto:
Commencing at the East quarter corner of said Section 1 ; thence
South 81013'28" West 2645.30 feet to the Northwest corner of the
Plat of The Meadows at Redwood P.U.D. , Phase I, thence along the
West boundary of the said Plat of The Meadows at Redwood P.U.D. ,
Phase I, 122.06 feet along the arc of a curve concave to the West
having a central angle of 15°56' 10", a radius of 438.85 feet, the
long chord of the said curve bears South 06 52'05" East 121 .67
feet; thence continuing along the said West boundary, South
O1°06'00" West 605.00 feet to the North boundary of the said Plat
of Redwood Village P.U.D. , Phase II ; thence along the said North
boundary, South 88°54'00" East 170.38 feet to the TRUE POINT OF
BEGINNING of this description; thence continuing along the said
North boundary the following three (3) courses and distances, (1)
North 01006'00" East 37.91 feet; (2) South 88°54'00" East 160.00
feet; (3) North 47°03'17" East 224.60 feet; thence leaving the
said North boundary, South 01006'00" West 52.87 feet; thence
South 47003' 17" West 203.09 feet; thence North 88054'00" West
175.46 feet to the Point of Beginning.
The above described tract contains 0.3325 acres or 14485 square
feet and is subject to all easements and rights-of-way now
existing or of record.
be, and the same hereby is, vacated, abated and abolished.
Introduced, considered favorably on first reading and ordered
published this 4th day of December, A.D. 1986, and to be presented for
final passage on the 16th day of December, A.D. 1986.
