OF THE COUNCIL OF THE CITY OF FORT COLLINS
RELATING TO AFFIDAVITS OF INTENT FOR WRITE-IN
CANDIDATES FOR COUNCIL OFFICE
WHEREAS, Section 31-10-306 of the Colorado Municipal Election Code
states that the governing body of a municipality may provide by ordinance
that no write-in votes for any municipal office shall be counted unless an
affidavit of intent has been filed with the clerk by the person whose name
is written in prior to five days before the day of the election indicating
that such person desires the office and is qualified to assume the duties
of that office if elected; and
WHEREAS, the Council of the City of Fort Collins desires to establish
a procedure for the filing of such an affidavit of intent by write-in
candidates for Council office.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that a new section be added to the Code of the City of Fort
Collins as follows:
"§9-9 .1 Write-in Candidate Affidavit.
No write-in for city council office shall be counted
unless the person whose name appears as the write-in
vote has filed an affidavit of intent with the city
clerk , no later than the close of business five days
before the election, indicating that such person
desires and , if elected , is qualified for the
office."
Introduced, considered favorably on first reading and ordered pub-
lished this 19th day of March, A.D. 1985, and to be presented for final
passage on the 2nd day of April , A.D. 1985 .
