HomeMy WebLinkAbout2022-100-09/20/2022-SUPPORTING A GRANT APPLICATION FOR GRAY AND BLACK MARKET MARIJUANA ENFORCEMENT FUNDING FOR FORT COLLRESOLUTION2022-100OFTHECOUNCILOFTHECITYOFFORTCOLLINSSUPPORTINGAGRANTAPPLICATIONFORGRAYANDBLACKMARKETMARIJUANAENFORCEMENTFUNDINGFORFORTCOLLINSPOLICESERVICESWHEREAS,FortCollinsPoliceServices(“FCPS”)isapplyingforagrantthroughtheGrayandBlackMarketMarijuanaEnforcementGrantProgram(the“Program”)fromtheStateofColoradoDepartmentofLocalAffairs(“DOLA”)tofindinvestigationandprosecutionofunlicensedmarijuanacultivationanddistributionoperations(the“Project”);andWHEREAS,theProgramprovidesfinancialassistancetolocallawenforcementagenciesanddistrictattorneysthroughlocalgovernments;andWHEREAS,thetotalamountofgrantmoneytobedispersedstatewidebyDOLAamongstapplicantagenciesanddistrictattorneysis$900,000forFY2022-2023Programfunding;andWHEREAS,untilsubmittalofanapplication,FCPSdoesnotknowtheamountthatmaybeawarded;andWHEREAS,inFY2021-2022,FCPSreceived$44,805.16fromtheProgram;andWHEREAS,in2022,PoliceServicescontinuesreceivingcomplaintsaboutthesaleofhempintoxicantstominorsatlocalsmokeshops(notlicensedmarijuanabusinesses)andhasseveralactiveinvestigations;andWHEREAS,previouslyawardedProgramfundswereusedtoinvestigatecomplaintsinbothsmokeshopsandresidencesandinonecaseledtotheseizureofover100poundsofillegalmarijuana,whichledtofelonycharges;andWHEREAS,thecurrentProgramexpiresonJune30,2023,andPoliceServicesrecommendsthecontinuationoftheabovereferencedgrey-andblack-marketmarijuanainvestigations;andWHEREAS,FCPShasutilizedmoneyfromtheProgramtoacquirelong-termevidencestorageunitsforillegalblack-marketmarijuana,andforanincreaseinstaffingtohelpwithinvestigationsofblack-marketgrowoperationsintheCity;andWHEREAS,aspartoftheProgramgrantapplicationprocess,DOLArequiresthatthegoverningbodyofanyentityapplyingforgrantfundspassaresolutiontoshowthatitisawareofandsupportstheapplication,andrecognizestheobligationsthegrantcreates;andWHEREAS.theCitywouldnotberequiredtoprovideanymatchingfundstowardtheProject;and—1— WHEREAS,thegrantmoneywouldallowFCPStocontinuetoimproveneighborhoodlivabilityandprovideinsightintotheextentoftheproblemsassociatedwithunlicensed,illegalmarijuanaactivityintheCity.NOW,THEREFORE,BEITRESOLVEDBYTHECOUNCILOFTHECITYOFFORTCOLLINS,asfollows:Section1.ThattheCityCouncilherebymakesandadoptsthedeterminationsandfindingscontainedintherecitalssetforthabove.Section2.ThattheCityCouncilherebysupportstheCity’sFY2022-2023applicationforagrantthroughtheProgramfromDOLAtofirndtheProject;andSection3.Thatifthegrantisawarded,theCityCouncilsupportsthecompletionoftheProject.PassedandadoptedataregularmeetingoftheCouncilofthedayofSeptember,A.D.2022.ATTEST:Collinsthis20th-2-
