Graham Paralegal Brownstein Hyatt Farber Schreck, LLP 410 Seventeenth Street, Suite 2200 Denver, CO 80202 Re: Zoning Compliance Verification for 382 E Mountain Ave., Fort Collins, CO (the "Property') Dear Ms. Graham: In response to your request for information regarding the above referenced Property, we have researched our files and represent the following: 1. The current zoning classification for the subject Property is D (Downtown District). 2. According to the zoning ordinances and regulations of this district, the use of the subject Property is a permitted use. 3. According to the zoning ordinances and regulations of this district applicable to this Property, the structure is legally conforming. Comments: While the structures were built to conform, over the years, Riverside Drive has expanded and changed the original right-of-way line. The canopy located on the northeast corner may or may not straddle the property line. Without a current improvement location certificate we cannot make that determination at this time. 4. In the event of a casualty to the Project, in whole or in part, the structure may be rebuilt in its current form (i.e. no loss of sq. footage, same footprint, with drive through(s), if applicable) 5. Based on our records, the Project complies with, or is otherwise exempt from, applicable subdivision requirements 6. The current parking requirements for the subject Property/Project are: 3 Total Parking Spaces required (# Regular 2 # Handicapped 1) 7. Certificate of Occupancy, status: A valid Letter of Completion has been issued for the Project and a copy is attached. This information was provided on April 29th, 2016, by the undersigned, on behalf of The City of Fort Collins per request and as a public service.
