This exemption is found in the Colorado Air Quality Control Regulations and Ambient Air Quality Standards; Regulation 3, Part A, Section II,D,1(e). It states that commercial food service establishments using wood fired equipment in PM-10 attainment areas are exempt from APEN requirements. Fort Collins is currently a PM- 10 attainment area. However, the restaurant would still have to comply with the State Air Quality 200 opacity regulation. If you have any questions please feel free to call me at 498- 6789.
