According to the State Air Quality Regulations, the Kenny
Rogers Roasters Restaurant in Fort Collins would be exempt from
applying for a Air Pollution Emissions Notice (APEN).
This exemption is found in the Colorado Air Quality Control
Regulations and Ambient Air Quality Standards; Regulation 3, Part
A, Section II,D,1(e). It states that commercial food service
establishments using wood fired equipment in PM-10 attainment areas
are exempt from APEN requirements. Fort Collins is currently a PM-
10 attainment area.
However, the restaurant would still have to comply with the
State Air Quality 200 opacity regulation.
