Plum Street as requested by PFromar for authorization of -electrical service re-energization. Electrical service to the building had been ordered to be disconnected by this office following a fire in the basement a few days earlier. Our inspection revealed some hazardous conditions which deemed it necessary for me to post the basement apartment "unsafe for occupancy" as stipulated in Section 404(a) of the Uniform Code for the Abatement of Dangerous Building, 1976 Edition. Specifically, the conditions are detailed in the following outline: a) Open stairway to basement - one side of the stairway is completely unprotected with no handrail/guardrail barrier. Serious injury could be inflicted upon someone striking the basement floor, especially a child or elderly person. Section 1716 of the City Building Code re- quires a handrail mounted 30 inches to 34 inches above the treads with intermediate rails that will prevent a 9" diameter sphere from passing through. b) Inadequate emergency exits from basement sleeping rooms - Only one "tilt -out" type window approximately 1 ft. high x 2 ft. wide is located in each sleeping room. In addition to the small size of the windows, the fact that the sills are nearly 5 ft. or more above the floor further restricts emergency exiting. Section 1404 of the City Building Code specifies an egress window with a minimum clear openable area of 5 sq.ft., no dimension less than 22 in., and a maximum sill ht. of 48 in. above the floor. This present condition severely limits exit and rescue attempts in the event exiting out of a bedroom door is obstructed by fire or other catastrophe. continued - PAGE TWO 6/30/80 310% E. Plum Street Because the above defects exist to the extent that the "life, health, safety property of the occupants is endangered", the dwelling is classified as a "dangerous building" by definition in Section 302 of the Dangerous Building Code. Item No. 12 of this section references the City Building Code for compliance requirements. As owner of the building you are required by the Dangerous Building Code to make the necessary corrections noted above. The basement cannot be used for sleeping rooms until the windows are enlarged. However, the required stair rail must be installed in any event, even if the basement is not used as a separate dwelling unit. Section 401(b) of the Dangerous Building Code further stipulates that the necessary building permit be obtained and con- struction begin no later than 60 days from the date of this notice. Please be advised that you have the right to appeal my action provided a written appeal form is filed within 30 days from receipt of this notice. A $25 filing fee must accompany the appeal form which can be obtained in our office. The Building Board of Appeals meets at 9:15 A.M., the 1st Tuesday each month. The filing deadline is noon, one week prior to the hearing date. Please contact me if you have any questions and to inform me of your intentions.
