RE: Four Seasons Declaration of Easement
Dear Tim:
This letter is with regard to our conversation about the
Declaration of Easement pertaining to the Four Seasons PUD. It
is my understanding that Bill Neal of Wheeler Realty has
confirmed the .absence of any existing utilities within the
easements described in the above -mentioned Declaration of
Easement.
. In view of the language of the document and the absence of
any installed utilities, it is my opinion that the execution and
filing of this document did not effectuate any dedication to the
City of Fort Collins for public use. Accordingly, I do not think
it is necessary for the City to vacate. these easements by
ordinance or otherwise and that the vacation of the same may be
accomplished privately so as to not interfere with the
construction of improvements pursuant to the current planned unit
development.
If you require anything further from me with regard to this
matter, please do not hesitate to let me know. Thank you for
your assistance.

Dear Larry:
Please be advised that in light of your confirmation
that no utilities have been installed in the areas out-
lined in Chism's "Four Seasons Declaration of Easement",
Brown Farm Joint Venture will therefore not enforce the
document through its Architectural Control Committee
and hereby exempts you from any resultant future risk
resulting from the encroachment of your construction
of residential structures on any of the Ensenada Court
lots.
