Building Code Violation Notice
Order to Abate

Reference: Storage POD
The Larimer County assessor's office lists you as the owners of the above address. On July 1,
2014 you were informed that the temporary storage POD located on your front yard was
considered a zoning violation (copy attached), as of this date there has been no response from
you.
In addition to the zoning violation, you are hereby notified that you are now in violation of the
City's adopted 2012 International Residential Code (IRC) Section R105.1 which places the
responsibility for obtaining required building permits on to the property owner.
R105.1 Required. Any owner or authorized agent who intends to construct, enlarge, alter,
repair, move, demolish or change the occupancy of a building or structure, or to erect, install,
enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing
system, the installation of which is regulated by this code, or to cause any such work to be done,
shall first make application to the building official and obtain the required permit.
Structures for which a permit is required, must comply with zoning setbacks prior to the permit
being approved. The current location of the POD will not be able to satisfy the setback
requirements; therefore a building permit cannot be issued for the POD location on your
driveway. You will need to determine if it is possible to relocate the POD to your backyard,
comply with setbacks, and obtain the required permit or to store the materials in a commercial
storage facility or within the dwelling and remove the POD.
I am now requiring that within 30 days of the date of this notice, you have the POD removed
from the property or relocated on the property, obtaining the required permits, and obtain a final
City approval for its new location.
Failure to comply with this order to abate the violation in the timeframe given will result in the
City taking all legal actions necessary to abate the violation, including a summons to appear in
municipal court where fines of up to $1,000.00/day can be assessed.

Please resolve this issue by removing the storage POD from the property. I have no desire to
expend energies, mine or yours, pursuing legal actions to abate this violation.

Dear Landlord, Owner, Manager or Tenant, It has come to our attention that the property at the above address is in
violation: of the following sections) of the City of Fort Collins Land Use Code:
4.4(D)
Description of Violation:
A building permit is required for any structure over 120 SF or over 8 foot tall. Since this storage pod has
been in the same location for over 6 months the building official is requiring a building permit. This
structure will have to meet the setbacks for the RL (low density residential) zone which are: 15 feet on the
corner side and 20 feet in the front.
Please have these zoning code violations corrected by 7/11/2014 .
If you cannot comply within this lime limit, please contact this office and explain any mitigating circumstances you
feel may be cause for an extension. Please be advised that failure to comply can result in a court summons requesting
your appearance in Municipal Court. As a misdemeanor, a maximum of S1000.00 per day of violation can be
imposed.
