Dear Mr. Roberts
The City of Fort Collins is responsible for enforcement of zoning ordinances and similar codes or ordinances
related to development in the city of Fort Collins.
The above -referenced Property is located in the E (Employment) zoning district. The permitted uses in this
zone include lodging establishments (Section 4.27(13)(3)(c)(2) of the Fort Collins Land Use Code). The
Property in question was developed in accordance with the University Place PUD site specific development
plan that was approved on February 27, 1983. Therefore the current use of the Property as a Hilton Hotel
lodging establishment is a legal and approved use that is in compliance with the current Zoning Code. The
property is not in any special, restrictive or overlay district and no variances, special exceptions, conditional
use permits or zoning relief was granted to this property. The properties to the south and east are also
located in the E zoning district. The property to the west is Colorado State University (CSU) property, and is
not zoned. The properties to the north are zoned HMN (high density, mixed -use neighborhood) and CSU (not
zoned).
To the best of our knowledge, the Property complies with the requirements of the approved planned unit
development plan in all respects including, without limitation, use, density, parking, setbacks, height, floor/area
ratio, landscaping, etc. These requirements are set forth on the approved development plans, which can be
obtained from the City's Technical Services Department at 281 North College Avenue, 970-221-6588. There
are no nonconforming issues relevant to this Property, and we are unaware of the existence of any violations
of the zoning or building regulations applicable to the Property. The Property did not receive any variances,
special exceptions, or conditional use permits or zoning relief of any kind.
