The above -referenced Property is located in the NC (Neighborhood Commercial) and MMN (Medium Density Mixed -Use Neighborhood) zoning districts. The permitted uses in these zones include multi -family dwellings, duplexes and long term care facilities per Sections 4.23(B)(2)(a)(2), 4.23(B)(3)(a)(1), 4.6(B)(2)(a)(2), 4.6(B)(2)(a)(4) and 4.6(B)(3)(b)(2) of the Fort Collins. Land Use Code (LUC). The property in question was developed in accordance with the Rigden Farm —Tenth Filing site specific development plan that was approved on November 1, 2005 for a 116 unit independent living facility (aka multi -family dwelling), three duplexes and one multi -family triplex. Therefore the current uses of the property are legal and approved uses. There are no variances, special exceptions, conditional use permits, or nonconforming issues affecting this property and the property is not subject to any special, restrictive or overlay district requirements. The property may be rebuilt in its current form in the event of damage due to fire or other accidental cause or natural catastrophe. The abutting properties to the north are MMN and LMN (Low Density Mixed -Use Neighborhood). The properties to the south and east are MMN. The properties to the west are NC. To the best of our knowledge, there are no current zoning violations at the Property and the property complies with the current zoning and land use regulations and with the requirements of the approved site specific development plan in all respects including, without limitation, use, density, parking, setbacks, height, floor/area ratio, landscaping, etc. The requirements of the Rigden Farm — Tenth Filing site specific development plan are set forth on the approved development plans, which can be obtained from the City's Technical Services Department at 281 North College Avenue, 970- 221-6588. Valid certificates of occupancy have been issued for the Property. Please contact Marcha Hill at 970-416-2635 for the process to obtain copies of the certificates.
