Dear Ms. Vaquera:
This letter is a follow-up to the inspection of your property at 136 Second Street which was done
by Building Inspection Supervisor Mike Gebo on June 20, 1995. The purpose of Mr. Gebo's
inspection was. to examine structures that were built on your lot without building permits. He was
accompanied by an officer of the Fort Collins Police Department. Their inspection resulted in the
posting of a "Stop Work" order and an "Unsafe to Occupy" notice, requiring that the structures
be removed within 30 days, or necessary building permits obtained within that time. Because of
building code problems with the structures, Mr. Gebo believes that permits can't be obtained
since the structures won't be able to comply with the building code, therefore it would seem that
the only way to correct the building violations will be to remove the structures..
During the course of your conversation with Mr. Gebo; you evidently admitted that you house
approximately 20 migrant workers and.charge each worker $50.00 per week. This information is
similar to information given to the City by numerous residents of your neighborhood that have
complained about the nuisances created by the presence of your boarders..
The purpose of my letter is to inform you that the renting of rooms to more than 2 mule is a
violation of the Fort Collins Zoning Code. Specifically, Section 29-459 (9) (f) of the zoning code
stipulates that "The renting of rooms to DQJ more than two (2) persons per dwelling..." is a
permitted accessory use in the RM zoning district in which your property is located. Renting
rooms to more than 2 people results in the operation of a Boarding and Rooming House. Such a
use is not permitted in the RM zone (Section 29-177, Code of the City of Fort Collins).
As the owner of the property at 136 Second Street, it is your legal responsibility to keep its use
within the limits of the law. In order to provide you with time to correct the zoning violation by
removing your "boarders", July 30, 1995 has been established as a deadline for compliance.
Please be advised that failure to correct the situation by the deadline may result in the issuance of
a court summons for violation of City Code, and could result in a maximum fine of $1000. for
