As I stated, the "change of occupancy" process that you are looking into, is a permanent change for that address and stays with the building even if you sell to someone else. Variances of this nature are therefore not easily approved. My director has asked that you provide, from either a licensed general contractor or structural engineer (your detail of the conditions is insufficient, he is looking for someone with structural background), a report of the conditions and what it will take, construction wise, to bring the areas into compliance. The built-in cabinet will not be considered grounds for the variance. Your floor plan indicates that the bathroom is large enough to accommodate an accessible restroom. It appears it will require re -locating the sink and removing the tub, neither of which are considered extreme. The door to the restroom can be modified to a larger door and the hallway door seems to be able to be retrofitted with a new header making a larger doorway. All of these items are within the limits of what is considered acceptable modifications to provide access. On average, these types of change of occupancies do require this level of construction. Your request is on hold until the additional information stated above is received Also, you will need to provide a fire separation of 1 hour rating between the residential use and the office use. Any doors in the wall separating the uses will need to be 1 hour rated. Please be thinking of the easiest location with the least amount of openings to provide this rated wall as the 1 hour doors are moderately expensive.
