This will confirm my advice concerning the property of Sumner Brody
located at 2105 South Shields Street, Fort Collins. I understand that
this property was a part of the College Annexation which was completed
about three years ago. At the time the property came into the City,
Mr. Brody was conducting the same operations on the property which he
is now conducting and which consist of the manufacture and sale of fur
pieces. Mr. Brody is now attempting to sell the property and a question
has arisen as to the zoning entitlement in connection with this property.
Apparently, there is some question whether Mr. Brody was entitled to
conduct these operations on the property when it was in the county under
the county zoning resolution. If the business conducted on the premises
was lawful under the county zoning, then beyond question upon annexation
such operations could be continued as a nonconforming use in the City;
and in addition, the right to change operations to any use allowed under
the next higher zone which is granted by our zoning ordinance in connection
with nonconforming uses would apply to this property. It was my recommenda-
tion, and you concurred, that the City should not go behind the existing
use in the county and attempt to make a determination whether such use was
lawful under the county zoning. If as was the case here operations have
been conducted for some period of time in the county and the county
authorities have raised no objection, it would not seem proper for the
City to now question whether these operations were proper under the county
zoning. Therefore, except in unusual circumstances, I would recommend
that we accept any use which is being conducted in the county under its
zoning resolution at the time of annexation, if such use has continued
for any reasonable period of time in the county.

advise.

At your request we have made an investigation into your
entitlement to your non -conforming use status for your fur business
located at 2105 South Shields. Based upon our investigation
it would appear that you do have a valid non -conforming use
pursuant to Section 118-84 of the Code of the City of Fort
Collins. This would apply with respect to the presently
existing use consisting of light manufacturing and retail
selling incident to your fur business.
If you have any further questions, please do not hesitate to
contact me in this regard.

Dear Mr. Clyde,
Mr. Richard Troxell, Mountain West Realty, Fort Collins, Colorado,
has instructed us to write you concerning the purchasing of the Sumner
H. Brody property located at 2105 South Shields, Fort Collins, Colorado.
We intend to use this property as a family dwelling and to include
a small retail business. It is our understanding that you represent
the City of Fort Collins and are responsible for approving our proposed
actions in this matter. Only upon your approval will the contingency
be removed from our contract with Mr. Brody.
Our intentions are to leave the property as it now stands. We do
not anticipate any additions or alterations to the exterior or interior
of the dwelling proper or out buildings with the exceptions of minor
repairs, normal home decorating, and landscaping.
We intend to conduct our business in a manner similar to which
hr. Brody is conducting his present furrier operation. However, our
shop will include antiques, lamps, custom-made lampshades, needlepoint
items, and other small gifts.
We await your written approval or advisement concerning the use
of this property.

I appreciate the opportunity to be able to describes for you, how
I have used my property, located at 2105 South Shields# since purchasing
the home and acreage in June of 1964.
Since the date of purchase, I have operated a retail furrier
business attached to my home employing from two to five employees, at any
given time depending upon the reason, offering retail sales„ storage
and-repa-irr The property offers adequate rooms for pavkU4 apprm mately
twelve cars without any alterations.
Another point of interest is the means of advertising used sisce
the inception of V business. I have always maintained a 41 x 81 sign
twelve Leet from Shields Street, announcing the business nave and
stating that we offer sales, repair and storage.
I have enjoyed a high degree of success and freedom operating sky
bu"ness- at this- si z, and- wish- you- the- same- degree of success-.
