Collins, Cu 8ubz5 Dear property owner: IRE: Zoning Complaint 97-002, 402 East Lake Dr., Parcel Number 97133-29-009 We recently received a complaint regarding the use of the property you own at the above referenced address in Fort Collins. This property is located in the NCL(Neighorhood Conservationl Low Density) district which allows single-family dwellings as a permitted use (Section 29-117 (1], Code of the City of Fort Collins). Because it is located in this zone, this property may not contain more than one dwelling unit as a use by right. According to the complainant, a conversion may have been made creating an additional dwelling unit or a duplex residential structure. Current City records do not show a legal duplex conversion prior to your purchase of the property. In addition, all Zoning prior to the current NCL designation has never permitted residential units other than single family dwellings on this property. If a conversion has been made, then the situation is clearly in violation of City code. As owner of this property, it is your legal responsibility to keep its use within the limits of the law. We would ask that you investigate and assure compliance to the City Code no later than February 24, 1997. If a violation continues after this date, a summons may be issued requiring your appearance in Municipal Court. As a misdemeanor, a maximum fine of $1000 for each day of violation could be imposed if you are found guilty. I trust you will attend to this matter. Please call me at 221-6760 if have any questions.
