Dear Ms. Liley:
This letter is in regards to your decision to deny
authorization for the Arthur Treacher's to be located
in a RH zone. After careful review of your reasoning
for denial, our attorney and myself have made various
revisions to our site as well as to our building.
I am enclosing a copy of our revised site and floor plan.
These revisions were made to set forth an indoor
restaurant arrangement.
I would like to point out these revisions. The first
major modification was the elimination of our drive -
through facility. Elimination of our drive -through
W1nCOW establishes- total food distribution- to be $a1ely
indoor. The other major revision was the removal of
the patio, therefore, there shall be no outdoor eating
areas. With these revisions, our design reasoning for
the original site plan has changed. We have now
reoriented parking as well as traffic flow for the new
site plan.
To recap the above, the drive-in and the patio elimination
will produce food distrubution and consumption, on -site,
to be solely indoors.

Also enclosed in this package is a letter prepared by
Mr. Dave Giovacco, who is the president of the franchise
which will be the owners and operators of this stbre and _
• various stores located in Colorado. As you wi1D find in
his letter, his intentions of food distribution �aill be
similar to any typical sit down restaurant.
If you should have any questions concerning his operations, `
I am quite confident he would be happy to reply.
Another item of note, would be the type of material on which
the food is served. It is true that the food is served on a
disposable material. It is my opinion and belief that this
is of inerit in many respects. One point I would like to
touch on is the water waste which occurs in the washable
dishware procedures. I am sure your Health Department will
back my opinion and also answer your question on the water
waste involved in achieving the high manner of cleanliness
and sanitation required in the reusable dishware. Disposable
dishware does not require such operations and therefore
;, eliminates waste of our most valuable resource. I, myself,
see a more sanitary and resourceful manner of food distri-
bution in the use of disposable food service.
I would ask that you review your decision with the information
provided herewith. At this time we are carrying on contract
negotiations with the current owners and have a time limit
involved in this particular contract. Threrfore, again I
would please ask that you review your decision and return
an answer at your earliest convenience. ,
