Kennedy Parkway Building 2 Fort Collins, CO 80525 Dear Mr. Anderson: RE: Zoning Violation 97-003, 1225 W. Prospect, Prospect II PUD, Amended We have noticed for the past several months the installation of a banner offering "Condos for Sale" on the east side of Building 1 described above. On a number of occasions we have notified your office regarding the City's Sign Ordinance and requested your cooperation in obtaining a banner permit for the banner. Section 29-601 of the City code allows for the installation of temporary banners "provided a permit is obtained from the Zoning Administrator." It provides for the hanging of banners "for not more than twenty (20) days per calender year.' As recently as January 21, 1997, the banner was observed at 1225 W. Prospect Rd., Building 1. We have not received a permit request from you to hang this banner. Your failure in obtaining a banner permit prior to installing the banner referenced is clearly in violation of Sec. 29-601. As a user of the property, it is your legal responsibility to keep its use within the limits of the law. We would ask that you to assure compliance to the City Code no later than February 3, 1997. This would be accomplished by obtaining a banner permit prior to hanging a banner. You may also consider reducing the banner's size to twenty (20) square feet or less, mounting it rigidly to the building, and obtaining a regular sign permit for it. Please be advised that if a violation continues after this date, a summons may be issued requiring your appearance in Municipal Court. As a misdemeanor, a maximum fine of $1000 for each day of violation could be imposed if your are found guilty. I trust you will attend to this matter.
