The City of Fort Collins is responsible for enforcement of zoning ordinances and similar codes or
ordinances related to development in the city of Fort Collins.
The above -referenced property is located in the MMN (Medium Density Mixed -Use Neighborhood)
zoning district. The property abuts the MMN zone district on the North, RL (Low Density Residential)
zone district on the East and the West and both RL and MMN on the South. The permitted uses in
this MMN zone include multi -family dwellings (Section 4.6(13)(2)(a)4. of the Fort Collins Land Use
Code). The property in question was developed in accordance with the Unit Development Plan for
Tract K Southmoor Village Third Filing site specific development plan that was approved on
November 9, 1972. Therefore the current use of the property as a multi -family development is a
legal and approved use. The property is not in any special, restrictive or overlay district.
To the best of our knowledge, the property complies with the requirements of the approved site
specific development plan in all respects including, without limitation, use, density, parking,
setbacks, height, floor/area ratio, landscaping, etc. These requirements are set forth on the
approved development plans, which can be obtained from the City's Technical Services Department
at 281 North College Avenue, 970-221-6588. No variances, special exceptions, conditional use
permits or zoning relief were granted to this property. Further, there are no nonconforming issues
relevant to this property, and there are currently no known Zoning Code violations for the
development. If a building or structure were to be damaged by fire or other accidental cause or natural
catastrophe it can be reconstructed in accordance with the approved site specific development plan.
