Dear Mr. Doscas:
The City of Fort Collins is responsible for enforcement of zoning ordinances and similar codes or
ordinances related to development in the city of Fort Collins.
The above -referenced property is located in the MMN (medium density, mixed -use neighborhood)
zoning district, and is not subject to any overlay or special district requirements.
The permitted uses in the MMN zone include multi -family dwellings and any land use authorized
pursuant to a site specific development plan that was approved and processed in compliance with
the Zoning Code in effect on March 27, 1997. The property in question (legally addressed as 1640
and 1720 Kirkwood Drive) was developed in accordance with the Parkwood East Apartments PUD
site specific development plan that was approved and processed in compliance with the Code in
effect on March 27, 1997. Therefore the current use of the property as a multi -family development is
a legal and approved use. Certificates of occupancy for the various buildings at 1640 and 1720
Kirkwood Drive have been issued, and information about getting copies and the associated fees for
providing them maybe obtained by calling City of Fort Collins Building Department at 970-221-6760..
The property complies with the requirements of the approved planned unit development plan in all
respects including, without limitation, use, density, parking, setbacks, height, floor/area ratio,
landscaping, signage, etc... Further, there are no variances, conditional use permits, or
nonconforming use issues affecting this property and to the best of my knowledge, there are no
zoning violations existing at this time. Existing improvements on the property can be rebuilt in their
current configuration and density in the event that they are damaged or destroyed by accidental
causes. The requirements of the Parkwood East Apartments PUD are set forth on the approved
PUD plans, which can be obtained from the City's Technical Services Department at 281 North
College Avenue, 970-221-6588.
The property is not subject to any local rent control regulations and I am not aware of any other
permit or license required by this jurisdiction that a purchaser must obtain before it may acquire the
property or before the property may continue to be used in the manner in which it is presently being
used.
