Scott Billington Dillon -Vaughan -Walters Real Estate 1025 E. Swallow Road Fort Collins, Colorado 80525 Dear Scott: One of our building inspectors, Elmer Walston, met with you yesterday at 822 W. Oak Street for the purpose of inspecting the over/under duplex at that location in response to a zoning complaint which was filed with the Zoning Office. This inspection was conducted in order to determine whether or not the basement apartment in the building complied with the building codes which were in effect in 1976, the year when the basement was evidently converted to an apartment. Elmer's inspection revealed that this basement apartment did not comply with the applicable codes. Specifically, the bedroom egress windows are not large enough, there is no fan in the bathroom, no smoke detection system, the electric panel is not accessible to the basement unit, and the electric service is not separated. These deficiencies, along with the fact that we can find no record of a building permit, indicate that while this duplex may have been a permitted use in the RM zone in effect in 1976, it was not a legal use. Since the property is now located in the RL zone, wherein duplexes are not allowed, the only way the basement apartment can continue is if it is classified as a legal nonconforming use. In light of the above, however, we can not classify it as such. Therefore, the zoning complaint which was filed regarding an illegal duplex at 822 W. Oak still stands. In order for the violation to be corrected the owner must remove the kitchen stove from the basement apartment and call us for an inspection to verify this. I realize that this is not what you wanted to hear, but there is nothing that allows us to grant amnesty to a situation like this, nor is there any way we can issue a building permit for remodeling work necessary to bring the unit up to code now that the property is in the RL zoning district. • 1.. ..« t.. �... �:.hd. �:...., n.... RIGHT TO APPEAL This order may be appealed to the Building Board of Appeals in writing through the City Building Inspection Office at 300 LaPorte Avenue, 221-6760. Any appeal must be rude within 30 days of receipt of this notice, otherwise all rights to a hearing will be waived.
