This letter is in response to your request of 25 June, 1973 for a
variance from the provisions of the Fort Collins Building Code section
1407 (C) to permit a water closet compartment twenty-six (26) inches in
width in lieu of the required thirty (30) inches. I regret that I am
unable to allow your request. You will recall that your company made a
similar framing error in 1972; upon request of the purchaser, who was already
occupying the house, and with your assurance that it would not happen again
I issued a certificate of occupancy. I cannot find justification for
repeatedly allowing mistakes to go uncorrected. It is now occupied as a
sales office. Prior to selling it will be necessary that the defect be
corrected.

The house at 730 Tyler has been turned in for city occupancy.
However, an error exists in the framing between the shower wall
and the outside wall where the stool sits. The measurement was
for 26" and the code calls for 30".
We are,therefore, requesting that you make a variance on this
particular house. We have corrected our plans.
