As you may be aware, there have been some serious problems at your rental property on North Shields
Street in Fort Collins. The City has been contacted on a number of occasions over issues ranging from
building code violations to emergency police calls, as well as other miscellaneous landlord -tenant
disputes. City Codes & Inspections Administrator Mike Gebo will be handling the numerous code
violations for the property, and I will be addressing some of the other issues; in particular, where to go
from here regarding the numerous concerns of ex -tenant April Fougeron.
Ms. Fougeron has reported that, amongst other alleged threats, property manager Bobbie Vanatta has
stated she would not be returning any of Ms. Fougerods original security deposit. Ms. Fougeron lived in
the basement apartment for less than a month and will be officially moved out by March 31, 2001. It is
Ms. Fougerods hope that the issue of the security deposit can be addressed informally, through the use of
the Citys free and confidential Community Mediation Program, rather than having to resort to seeking
legal action. Ms. Fougeron will leave a forwarding address so that the security deposit can be returned
within 30 days, as is recommended in the City of Fort Collins Landlord -Tenant Handbook (available
online as an Adobe file: www.fcgov.com/neighborhoodresources/mediation.asp#12). Perhaps mediation
will not be necessary to resolve this matter but please know it is available and is being formally offered to
you at the request of Ms. Fougeron.
I have enclosed some materials about the Community Mediation Program for you to look over. If in fact
the security deposit refund becomes a problem, the mediation process may help you and your tenant come
to an agreement outside of court. Mediation gives people a chance to speak with each other in a safe and
neutral environment, and attempts to find win -win solutions to shared problems. Please contact me so
